The proposed amendments adjust the permitted and <br />conditional uses in Table 2-5.3 without taking away development rights of existing developments. <br />Additional proposed changes to Table 2-5.3 include removing redundances between land uses, updating <br />titles to match glossary definitions, and revising titles to more commonly used terms. Modifications were <br />also made to the footnotes related to pharmacies and storage yards. The proposed amendments to Table 2- <br />5.4, Size and Dimension Criteria, would modify the PMX-HIGH zoning district to increase the maximum <br />floor area ratio (FAR) from 1.5 to 2.0 and increase the maximum density to 80 dwelling units per acre. <br />These changes are consistent with the proposed amendments to the Comprehensive Plan provided in <br />Ordinance 22-1572. Section 5-21.2, Definition of Terms is proposed to be amended to add new definitions <br />for new land use types, and also existing land use types that did not previously have definitions. The <br />Planning and Zoning Commission, acting as the City's Land Planning Agency (LPA) voted unanimously <br />at its meeting on August 10, 2022 to recommend approval of this item to the City Commission. <br />Discussion: In response to a question from Commissioner Meadows, Ms. Hyson and City Attorney <br />Reischmann agreed that since the definition relating to micro -breweries mentions small-scale production <br />facilities, staff and the attorney should look at defining what is meant by that terminology and possibly <br />amending the definition prior to second reading of the ordinance to avoid any ambiguity and future <br />confusion. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager recommended approval of Ordinance 22-1573 on first reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 22-1573. Mayor Henson opened the floor for public participation. The <br />following individuals came forward to address Ordinance 22-1573: <br />1. Doug Markovitz, co-owner of Casselberry Liquor, 130 SR 436, again expressed support for <br />increasing density to allow for redevelopment but did not feel large retail establishments such <br />as BJ's were good fit for the City. <br />2. Brad Markovitz, co-owner of Casselberry Liquor, 130 SR 436, expressed concern that <br />representatives of BJ's Wholesale were not present at the meeting which in his opinion <br />indicated they did not care about the City, and what the City needed was small, independent <br />businesses rather than large retail establishments. <br />3. Ed Williams of Williams Development Services, 29 E. Pine Street, Orlando, stated that the <br />gentleman at the meeting with him was a representative of the property owner who had <br />already invested significant funds in trying to develop the property for location of a BJ's <br />Wholesale, and he felt that showed that the owner did, in fact, care about the City. <br />No one else came forward to address Ordinance 22-1573. Mayor Henson closed the public hearing relative <br />to Ordinance 22-1573. <br />MOTION: Vice Mayor Aramendia moved to approve Ordinance 22-1573 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 4-0. <br />
