Mr. Burnett made a motion that the Planning and Zoning <br />Commission approve case number SPR 21-11, based on the staff report and the testimony and evidence presented, <br />that the request meets the applicable provisions of the Unified Land Development Regulations and is consistent with <br />the Comprehensive Plan as per the written findings in the staff report, the four (4) conditions of approval and <br />Attachments A - G. Ms. Reischmann stated <br />that Mr. Bakalla filed the documentation for abstaining. <br />Ms. Reischmann excused herself from the meeting at 7:00 p.m. <br />Sixth Item of Business: CU 22-04: 906 and 908 State Road 436. A conditional use request for the sale of beer <br />and wine for on-site consumption (2COP) at V's Diner. <br />Ms. Christina Hyson, Chief Planner, reviewed the information provided in her memorandum dated May 11, <br />2022 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said staff recommends that case <br />number CU 22-04 be approved with staffs conditions, based upon the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is <br />consistent with the Comprehensive Plan as per the written findings contained within the staff report. The conditions <br />of approval are as follows: <br />1. The conditional use shall be limited to the location of 906 and 908 State Road 436. <br />2. All sales and consumption of alcoholic beverages, except for approved package sales, shall be on-site <br />and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the <br />most current local, state, and federal regulations and only as long as the Applicant complies with those <br />same regulations. <br />4. Sale of alcoholic beverages is prohibited when food service is not available. <br />5. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />6. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10- <br />2 of the City of Casselberry's Code of Ordinances. <br />7. The restaurant shall receive any and all other approvals for alterations to the building, ADA compliance, <br />building permit(s), fire -safety change of use approval, certificate of occupancy, City and County <br />
