The business shall remain in compliance with all City, County, and State requirements. <br />9. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />10. The conditional use shall commence within 180 days of the approval. <br />11. The conditional use shall expire if the use is discontinued for more than 90 days. <br />12. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question, Ms. Hyson said that the primary parking would be in the front of <br />the building. In response to the Commission's question, Ms. Hyson stated that the site meets the current ADA <br />parking requirements. <br />After a brief discussion regarding the percentage of food sale requirement, Mr. Hale asked the applicant to <br />come forward. Mr. Mackenzie Singleton, 906 - 908 State Road 436, Casselberry, Florida came forward. In response <br />to the Commission's question, Mr. Singleton said that the parking located behind the building would be used for <br />employee parking and it is a well -lit site. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Hale asked for a motion to address CU 22-04. Mr. Burnett made a motion that the Planning and Zoning <br />Commission approve case number CU 22-04 per the staffs conditions, based upon the staff report and the testimony <br />and evidence presented, that the request meets the applicable provisions of the Unified Land Development <br />Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff <br />report, the twelve (12) conditions of approval and Attachments A — C. Ms. Saporito seconded the motion. The <br />motion passed unanimously by voice vote. <br />Seventh Item of Business: CU 22.05: 861 and 863 State Road 436. A conditional use request for the sale of <br />beer and wine for on-site consumption (2COP) at La Terraza Bakery. <br />Ms. Antonia DeJesus, Planner II, reviewed the information provided in her memorandum dated May 11, <br />2022 to the City of Casselberry Planning and Zoning Commission. Ms. DeJesus said that the applicant would need <br />to submit a minor site plan application to add outdoor seating and alcohol sales would be limited to inside the building <br />until the site plan is approved. <br />Ms. DeJesus said staff recommends that case number CU 22-05 be approved with staffs conditions, based <br />upon the staff report and the testimony and evidence presented, that the request meets the applicable provisions of <br />
