DELIVERY <br />All prices shall be F.O.B. Destination, Casselberry, Florida. Delivery date and warranties must be written <br />out and submitted with bids. We insist delivery dates, as specified, be met. There will be no additional <br />charge for multiple delivery locations. <br />AWARD OF SOLICITATION <br />A. The Solicitation will be awarded to the Contractor whose submission is most advantageous to the <br />City, price and other factors considered. <br />B. The City reserves the right to accept and award item by item, and/or by group, or in the <br />aggregate, unless the Contractor qualifies his solicitation by specified limitations. <br />C. Successful Contractor shall be notified in writing of award. <br />D. Delivery of materials and/or services shall be performed upon receipt by successful Contractor of <br />a numbered, signed purchase order and a formal Notice to Proceed. <br />E. The City of Casselberry reserves the right not to award or to reject bids from Contractors that are <br />currently in litigation with the City or as a result of any prior lawsuits. <br />The bid will be for a period of three (3) years at a fixed price. However, by mutual consent of the City of <br />Casselberry and the successful Contractor, the contract for Towing Services may be extended for two (2) <br />additional one (1) year periods. This option will be in a written notice. This contract may be canceled in <br />whole or in part by the City or the Contractor upon giving at least thirty (30) days written notice prior to <br />cancellation; except that non-performance on the part of the Contractor will be grounds for termination. <br />Termination will take place within five (5) days of notification. <br />The Contractor awarded this annual contract is encouraged to permit any other governmental agency in <br />the area to participate in the contract under the same Terms and Conditions except allowances may be <br />made for differences in travel time. <br />The Contractor awarded this annual contract must meet and/or exceed all terms and conditions of the City <br />of Casselberry. <br />1. Complete all forms and attach proof of proper license (Occupational, State, etc.) and trade <br />certifications (see above). Bids submitted without proof of proper license and trade certifications <br />will be disqualified. <br />2. The Contactor awarded this contract agrees to comply with all laws, codes, rules & regulations <br />bearing on the conduct of work, including those of the Federal, State, County, and City of <br />Casselberry. <br />3. The Contractor shall assume liability for damage or loss resulting from wrongful act(s) or <br />negligence of its employees, agents, or sub -Contractors while they are on or off City owned <br />property. The Contractor or its insurer shall reimburse the City for any damage or loss within <br />thirty (30) days after a clairn is submitted. <br />d. The Contractor(s) will provide name(s) of any sub -contracting Contractors used; in addition, <br />Contractor will guarantee that each sub -Contractor possess and maintains required insurance and <br />licenses. (Attach proof of proper licenses and signed Agreements). <br />5. By submitting a bid, the offer certifies having fully read and understands this request for bid and <br />certifies full knowledge of the scope, nature, quantity and quality of work to be performed, and <br />detailed requirements of the services to be provided and the conditions under which the services <br />are to be performed. <br />6. Figures quoted shall remain firm for ninety (90) days or until acceptance of the offers quoted and <br />Agreement signed. <br />7. Award — The City of Casselberry anticipates awarding one (1) contract, but reserves the right to <br />award to more than one (1) Contactor if it is determined to be in the best interest of the City. <br />
