All bonds (Bid Surety and/or P&P) are to be issued from a company licensed to sell bonds in the State of <br />Florida and with a rating no less than A in the Best Key Rating Guide. The City has the right but not the <br />obligation to verify that these requirements are met. The Performance & Payment (P&P) Bond must be <br />delivered to the City on the specified date, but in no event later than the commencement date to perform <br />work under the contract. Failure or neglect to deliver said bonds as specified shall be considered as <br />having abandoned or defaulted under the contract, and the City shall have the right to exercise any and all <br />legal or equitable rights against the successful Contractor that the City deems are in the best interests of <br />the City including, but not limited to, a claim for damages (including reimbursement of attorney's fees <br />and costs incurred by the City), termination of the contract, and selection of another Contractor to perform <br />the work. Letters of Credit are not acceptable in lieu of the required bonds. The P&P Bond must be <br />effective from the cormnencement date of the project until the City has acknowledged in writing that the <br />project has reached final completion and all persons that provided labor, services, and materials for the <br />prosecution of the work provided for in the contract have been fully paid. Be advised that the surety or <br />sureties must agree to adjust the bonds to the contract price as it may be modified by approved change <br />orders and will be deemed to legally and conclusively waive notice of such change. P&P Bond will be <br />required by the successful Contractor within three days after commencement of any services pursuant to <br />this Agreement. Each Contractor shall submit with their response a signed letter from their surety <br />company which details their bonding capacity. Successful Contractor shall provide an updated letter on an <br />annual basis upon the City's request. <br />BOND <br />The Contractor, if awarded Bid, must post a cash bond in the amount of $1000.00 with the City Clerk of <br />the City of Casselberry to be used by said City in the event the Contractor fails to provide wrecker service <br />as required in these specifications for the purpose of defraying costs incurred by the City of Casselberry <br />in making adequate arrangements for the removal of wrecked, illegally parked, or abandoned vehicle. <br />LICENSES <br />Please make sure Licenses (Occupational, State etc.) and Certifications (Florida Certified Towing and <br />Recovery Operator Certificate, Nationally Certified Tow Operator, Nationally Certified Master Tower, <br />Community Emergency Response Team Certificate etc.) are attached with Bid sheets. Any Bid sheet <br />submitted without requested licenses and certificates will be disqualified. <br />BID PRICES <br />The Contractor warrants by virtue of bidding that the prices, terms and conditions quoted in this bid will <br />be firm for a period of ninety (90) days from the date of the bid opening unless otherwise specified by the <br />Contractor, and shall not be amended after the date and time of the bid opening. Any attempt by a <br />successful Contractor to amend said bid prices except as otherwise provided herein shall constitute a <br />default. <br />Amounts specified herein are for fixed price work or products, including all prices for equipment, labor <br />and materials required to perform the work or deliver the product(s) specified herein. The Contractor, <br />having familiarized itself with the local conditions, and conditions listed here, proposes to furnish all <br />labor, materials, equipment and other items, facilities and services, without exception, for the proper <br />execution and completion of the contract, and if awarded the contract, to complete the required work or <br />deliver the required product(s) as specified within the bid/proposal package set forth by the City of <br />Casselberry. <br />11 <br />
