EXHIBIT `A' <br />PROJECT NUMBERS 0813-0816 <br />SECTION 00500 <br />AGREEMENT <br />1. THIS AGREEMENT, made as of the 13 day of October, 2008, by and between the <br />City of Casselberry, Florida, hereinafter called the Owner and Emerald Utilities & Site <br />Development hereinafter called the Contractor, <br />WITNESSETH, that the Owner and the Contractor, for the considerations stated herein, <br />agree as follows: <br />2. SCOPE OF WORK <br />The Contractor shall provide and furnish all of the necessary labor, supervision, material, <br />tools, expendable and permanent equipment, and all utility and transportation services <br />required to perform and complete in a workmanlike manner, all of the work described as: <br />WRCS Projects as a Result of Tropical Storm Faw' for the City of Casselberry, Florida. <br />All work shall be performed in strict accordance with the Drawings & Specifications <br />prepared in part by CPH Engineers, Inc., HDR Engineering, Inc. & CDM, Inc. hereinafter <br />called the Engineer, and in strict compliance with the Contractor's Proposal as accepted, <br />including any amendments agreed upon at the time of execution of this Agreement, and <br />with the other Contract Documents herein mentioned which are a part of this Agreement. <br />3. THE CONTRACT PRICE <br />The Owner shall pay to the Contractor, and the Contractor shall accept, in full payment for <br />the performance of this Agreement, subject to any additions or deductions provided for <br />hereby, based upon unit prices provided in the proposal attached hereto, in current funds, <br />the Total Aggregate Amount shall not exceed the sum of: ONE MILLION TWO <br />HUNDRED ELEVEN THOUSAND ONE HUNDRED DOLLARS AND 60/CENTS <br />($1,211,100.60) as unit price contract. <br />Payments are to be made to the Contractor in accordance with and subject to the <br />provisions embodied in the other documents, which are a part of this Agreement. <br />00500-1 <br />City of Casselberry <br />Version 9108 <br />
