EXHIBIT `A' <br />PROJECT NUMBERS 0813-0816 <br />4. CONTRACT TIME AND LIQUIDATED DAMAGES <br />Work under this Agreement shall be commenced within ten (10) calendar days after <br />issuance of written Notice to Proceed (anticipated date for the Notice to Proceed is <br />the week of October 13, 2008), and shall be completed no later than Monday, January <br />12, 2009. Contractor shall pay the Owners as liquidated damages the amount of ONE <br />THOUSAND FIVE HUNDRED DOLLARS & NO/CENTS ($1,500) for each calendar day <br />that expires after the Contract Time specified above including any adjustments thereof <br />approved by proper Change Order until the Work is finally complete. This amount <br />represents an estimate of Owner's damages for loss of use and administrative costs <br />associated with delay. <br />5. AUTHORITY AND RESPONSIBILITY OF THE OWNER <br />All Work shall be done under the general supervision of the Owner. The Owner shall <br />decide any and all questions which may arise as to the quality and acceptability of <br />materials furnished, work performed, rate of progress of work, interpretation of <br />Specifications, and all questions as to the acceptable fulfillment of the Agreement on the <br />part of the Contractor. These provisions shall not release the Contractor from any <br />Contractor responsibility contained herein. <br />6. CONTRACT DOCUMENTS <br />The Agreement comprises the Contract Document listed herein. In the event that any <br />provision of one Contract Document conflicts with the provisions of another Contract <br />Document, the provision in that Contract Document first listed below shall govern, except <br />as otherwise specifically stated: <br />a. Agreement (this instrument); <br />b. Change Orders <br />C. Addenda to Contract Documents, Nos. ; <br />d. Proposal; <br />e. Instructions for Bidders; <br />f. Detailed Specification Requirements; <br />g. Drawings <br />h. General Conditions; <br />i. Advertisement; <br />j. Performance and Payment Bonds; <br />k.
