RESOLUTION 08-1948 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AWARDING THE BID AND AUTHORIZING THE EXECUTION OF THE AGREEMENT WITH EMERALD UTILITIES AND SITE DEVELOPMENT FOR THE NRCS PROJECTS AS A RESULT OF TROPICAL STORM FAY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry has identified four (4) project areas in need of structural and non- structural erosion control measures; and WHEREAS, these erosion control measures will alleviate the pervasive erosion experienced within the project areas; and WHEREAS, the City of Casselberry properly advertised for bids for the NRCS Projects as a result of Tropical Storm Fay and on October 8, 2008, the City received thirteen (13) sealed bids; and WHEREAS, Emerald Utilities and Site Development has submitted the lowest bid in the amount of $1,211,100.60, and has performed similar work for neighboring cities; and WHEREAS, City staff has reviewed the bid proposal from Emerald Utilities and Site Development in the amount of $1,211,100.60, and found it to be the lowest responsive, responsible, and adequate bid proposal to meet the project requirements of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby awards the bid and approves the Agreement with Emerald Utilities and Site Development, attached as "Exhibit A", and authorizes the Mayor to execute said document on behalf of the City. SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
