First Reading of Ordinance 12-1379 — Amendments to ULDR Section 2-7.10(c)_ Fences and Walls ^ The City Clerk read Ordinance 12-1379 by title as follows: "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY, FLORIDA, CODE OF ORDINANCES, PART III, "UNIFIED LAND DEVELOPMENT REGULATIONS", CHAPTER II, "DISTRICT AND GENERAL REGULATIONS" TO AMEND ARTICLE VII, SECTION 2-7.10 "FENCES AND WALLS", TO INCLUDE REGULATIONS FOR THE NUMBER OF FENCES AND WALLS ALONG THE PERIMETER OF A LOT; REGULATIONS FOR ATTACHMENTS TO EXISTING FENCES IN RESIDENTIAL DISTRICTS; AND TO CHANGE THE REGULATIONS FOR FENCES ON THROUGH LOTS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." (LPA 12-08) Staff Presentation: Sandra Smith, Development Services Manager, gave a brief overview of the item, ex -lamina that staff was requesting amendments to various portions of Sectio n 2-71 A / \ f41 (`'4. �s ITT nD i ' 11 g u J pV - / V `l ) Vl Ll le -L.Y J l --Ix relating to fences in residential districts. She explained that, if approved, the amendments would allow most owners of a through lot to fence their rear yard without requiring a variance; prohibit property owners from erecting two parallel fences on the same property line of their lot; and require attachments to fences to be of a similar material, color and design. In response to questions from the Commission, Ms. Smith advised that the requirement for fence attachments would be only with issuance of new permits, not for existing attachments. She also advised that if passed on first reading tonight, the Ordinance would come back to the Commission as an advertised public hearing on September 20'. Budget Impact: There is no impact to the City's budget. Recommendation: The Interim City Manager and the Community Development Director recommended approval of Ordinance 12-1379 on first reading. Audience Input: The following individual(s) came forward to address Ordinance 12-1379: Mr. John Casselberry, 700 South Lost Lake Lane, voiced opposition to the Ordinance, stating that he did not feel the requirement for uniformity in fencing material was necessary. Mayor Glancy addressed Mr. James Fraleigh prior to his comments, warning him that disruptive behavior would not be acceptable, and if she or any member of the Commission determined that his behavior was disrespectful or disruptive to the meeting, he would be interrupted and asked to be seated.
