Motion was seconded by Vice Mayor Hufford. Motion carried <br />4-1 by voice vote, Commissioner Miller dissenting. <br />B. First Reading of Ordinance 12-1379 — Amendments to ULDR Section 2-7.10(c)_ <br />Fences and Walls ^ <br />The City Clerk read Ordinance 12-1379 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY OF CASSELBERRY, FLORIDA, CODE OF ORDINANCES, PART III, <br />"UNIFIED LAND DEVELOPMENT REGULATIONS", CHAPTER II, "DISTRICT AND GENERAL <br />REGULATIONS" TO AMEND ARTICLE VII, SECTION 2-7.10 "FENCES AND WALLS", TO <br />INCLUDE REGULATIONS FOR THE NUMBER OF FENCES AND WALLS ALONG THE <br />PERIMETER OF A LOT; REGULATIONS FOR ATTACHMENTS TO EXISTING FENCES IN <br />RESIDENTIAL DISTRICTS; AND TO CHANGE THE REGULATIONS FOR FENCES ON <br />THROUGH LOTS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." (LPA 12-08) <br />Staff Presentation: Sandra Smith, Development Services Manager, gave a brief overview of the item, <br />ex -lamina that staff was requesting amendments to various portions of Sectio n 2-71 A / \ f41 (`'4. �s ITT nD <br />i ' 11 g u J pV - / V `l ) Vl Ll le -L.Y J l --Ix <br />relating to fences in residential districts. She explained that, if approved, the amendments would allow most <br />owners of a through lot to fence their rear yard without requiring a variance; prohibit property owners from <br />erecting two parallel fences on the same property line of their lot; and require attachments to fences to be of a <br />similar material, color and design. <br />In response to questions from the Commission, Ms. Smith advised that the requirement for fence attachments <br />would be only with issuance of new permits, not for existing attachments. She also advised that if passed on <br />first reading tonight, the Ordinance would come back to the Commission as an advertised public hearing on <br />September 20'. <br />Budget Impact: There is no impact to the City's budget. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />approval of Ordinance 12-1379 on first reading. <br />Audience Input: The following individual(s) came forward to address Ordinance 12-1379: <br />Mr. John Casselberry, 700 South Lost Lake Lane, voiced opposition to the Ordinance, stating <br />that he did not feel the requirement for uniformity in fencing material was necessary. <br />Mayor Glancy addressed Mr. James Fraleigh prior to his comments, warning him that disruptive behavior <br />would not be acceptable, and if she or any member of the Commission determined that his behavior was <br />disrespectful or disruptive to the meeting, he would be interrupted and asked to be seated. She advised that if <br />the disruptive behavior occurred a second time, he would be asked to leave the meeting. She added that under <br />
