Mr. Fraleigh indicated that he understood the rules of decorum but felt that his <br />Constitutional right to free speech and expression of his opinion was being denied. <br />2. Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to the Ordinance, expressing <br />concerns that many people would not be able to afford the required type of fencing. He added <br />that he felt people should have a choice about what type of fence is on their own property. <br />3. Mr. Richard Henderson, 127 Mark David Boulevard, voiced opposition to the Ordinance, <br />stating that he also felt that many people would not be able to afford the required fencing. He <br />expressed concern that the requirement would lead to code enforcement proceedings and <br />possible fines for those people who could not afford the required fencing. <br />MOTION: Vice Mayor Hufford moved to approve ordinance 12-1379 on first reading, as <br />presented. Motion was seconded by Commissioner Solomon. <br />Discussion: Discussion ensued regarding the requirements of the proposed ordinance. In response to <br />questions from the Commission, Ms. Smith clarified that the ordinance did not require additional fencing. She <br />reiterated that the amendments being considered were to require removal of an existing fence on a property line <br />prior to installation of a new fence; to require use of the salve type of material used on an existing fence when <br />increasing the height or length of the fence; and to relieve citizens from having to go through a variance <br />process in order to install a fence in the back yard of a house facing a different direction than most of the <br />homes on a street where all the houses have a front street and rear street. She also confirmed that existing <br />fences already having attachments would be grandfathered in and would not be expected to change anything to <br />meet the new requirements. <br />Motion carried unanimously by voice vote 5-0. <br />C. First Reading of Ordinance 12-1380 — Establishing a Special Service Fee for <br />Outstanding Lien Searches <br />The City Clerk read Ordinance 12-1380 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, ESTABLISHING A SPECIAL <br />SERVICE FEE FOR OUTSTANDING LIEN SEARCHES AND AUTHORIZING ASSESSMENT OF <br />THE SPECIAL SERVICE FEE BY THE CITY CLERK; PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Staff Presentation: City Clerk Donna Gardner gave a brief overview of the item, explaining that the proposed <br />ordinance provides for establishment of a special service fee in the amount of $25.00 for outstanding lien <br />searches in conjunction with real estate transactions on individual parcels both within and outside the City <br />limits. She advised that Florida Statutes Sections 166.201 and 119.07(4)(d) provide the authority for the City <br />to assess fees which are necessary for the conduct of municipal government, and to charge a special service fee <br />in addition to the actual cost of duplication if the nature or volume of a public records request to be inspected <br />or copied requires extensive clerical or supervisory assistance. She stated that this is the case with lien <br />searches, with each search requiring approximately 30 minutes to 1 hour of cumulative staff time, and the <br />
