CASSELBERRY CITY COMMISSION <br />Minutes of August 27, 2012 — Regular Meeting <br />Page 11 of 20 <br />number of searches averaging 47 per month for the current fiscal year. <br />Ms. Gardner explained that if approved on first reading, the Ordinance would be brought back for a public <br />hearing at the September 24th meeting, and if adopted, the fee would become effective October 1, 2012. She <br />advised that based on the past three years, it was estimated that this fee would generate approximately $13,500 <br />in revenue to the General Fund each year. <br />In response to questions from the Commission, Ms. Gardner clarified that the majority of the lien search <br />requests are from title companies and lien search companies. <br />Budget Impact: Based on the volume of the last three years of outstanding lien searches conducted by the <br />City Clerk, it is estimated that $13,500 in special service fees will be collected annually. <br />Recommendation: The Interim City Manager and the City Clerk recommended approval of Ordinance 12- <br />1380 on first reading. <br />Audience Input: The following individual came forward to address Ordinance 12-1380: <br />Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to the Ordinance, stating that he felt <br />it was basically another tax on the residents of the City. He suggested that the item should be <br />tabled and the language be revised to apply only to professionals and companies that are using <br />the service, and not to individual residents, <br />MOTION: Vice Mayor Hufford moved to approve ordinance 12-1380 on first reading, as <br />presented. Motion was seconded by Commissioner Solomon. <br />Discussion: A brief discussion ensued regarding the proposed fee and those who would be affected by it. Ms. <br />Reischrnann pointed out that the proposed fee was well below the actual cost of gathering the information <br />necessary for the searches, and that approximately 70-80 percent of all cities charged a similar fee for lien <br />searches. <br />Motion carried unanimously by voice vote 5-0. <br />11.
