CASSELBERRY CITY COMMISSION <br />Minutes of August 27, 2012 — Regular Meeting <br />Page 8 of 20 <br />MOTION: Vice Mayor Hufford moved to approve Resolution 12-2407, as presented. <br />Motion was seconded by Commissioner Solomon. <br />Discussion: Additional brief discussion ensued regarding safety concerns related to lighting deficiencies; new <br />LED technology; and future funding for the street lighting program. <br />Motion carried 4-1 by voice vote, Commissioner Aramendia dissenting. <br />10. FIRST READING OF ORDINANCES <br />A. First Reading of Ordinance 12-1378 — Amending City Code Section 82-13, <br />"Abandoned or Derelict Vehicles" <br />The City Clerk read Ordinance 12-1378 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY FLORIDA; AMENDING TEXT WITHIN <br />THE CITY OF CASSELBERRY CODE OF ORDINANCES, PART II, CHAPTER 82, TRAFFIC AND <br />VEHICLES, ARTICLE I, SECTION 82-13, "ABANDONED OR DERELICT VEHICLES", TO <br />ELIMINATE PARKING OF INOPERABLE VEHICLES IN CARPORTS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Sandra Smith, Development Services Manager, gave a brief overview of the item, stating <br />that the amendment was necessary in order to provide consistency between language in this section of the City <br />Code and language previously adopted in the ULDR relating to parking of vehicles. Ms. Smith advised that if <br />approved on first reading, second reading of the Ordinance would be scheduled for the September 24`h <br />Commission meeting. <br />In response to questions from the Commission, Ms. Smith explained that parking of unlicensed or inoperable <br />vehicles would also not be allowed in back yards, but would have to be in an enclosed garage or removed from <br />the property. She also explained that Code Compliance Officers had the right to request that a resident start <br />and move a vehicle to demonstrate that it is operable. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The Interim City Manager and the Community Development Director recommended <br />approval of Ordinance 12-1378 on first reading. <br />Audience Input: The following individual came forward to address Ordinance 12-1378: <br />1. Mr. John Casselberry, 700 South Lost Lake Lane, voiced opposition to the Ordinance, stating <br />that he felt the requirements in the Ordinance would possibly present a financial burden to <br />residents. <br />No one else came forward to address Ordinance 12-1378. <br />
