CASSELBERRY CITY COMMISSION <br />Minutes of March 28, 2022 — Regular Meeting <br />Page 4 of 14 <br />Restoration Program Property Owner Conditional Closure Agreement for PCPP discharges with the Florida <br />Department of Environmental Protection to be eligible for state funding for petroleum contamination <br />assessment and remediation at the City's Water Reclamation Facility through the Petroleum Cleanup <br />Participation Program is requested. <br />Budget Impact: Approving the Petroleum Restoration Program Property Owner Conditional Closure <br />Agreement for PCPP discharges creates no immediate impact to the City Budget. Any funding needed to <br />be contributed by the City is subject to future City Commission approval. <br />Recommendation: The City Manager and the Public Works Director recommended approval of <br />Resolution 22-3300 which authorizes executing the Petroleum Program Property Owner Conditional <br />Closure Agreement for PCPP discharges with the Florida Department of Environmental Protection to be <br />eligible for state funding for petroleum contamination assessment and remediation at the City's Water <br />Reclamation Facility through the Petroleum Cleanup Participation Program. <br />D. Resolution 22-3301 — Utility Easement Agreement with Windward Square <br />Homeowners Association, Inc. for the Windward Square Subdivision <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, APPROVING A UTILITY EASEMENT AGREEMENT WITH WINDWARD SQUARE <br />HOMEOWNERS ASSOCIATION, INC. FOR THE WINDWARD SQUARE SUBDIVISION; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Introduction: Consideration of approval of Resolution 22-3301 which provides for a Utility Easement <br />Agreement with Windward Square Homeowners Association, Inc. for the utility lines located within the <br />Windward Square Subdivision is requested. <br />Budget Impact: there is no impact to the City Budget. <br />Recommendation: The City Manager and the Public Works Director recommended approval of <br />Resolution 22-3301 approving the Utility Easement Agreement with Windward Square Homeowners <br />Association, Inc. for the Windward Square Subdivision. <br />E. Resolution 22-3302 — Developer's Agreement Regarding the Smith Preparatory <br />School Located at 4921 South U.S. Highway iwa 17-92 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, REQUESTING CITY COMMISSION APPROVAL TO AUTHORIZE THE MAYOR <br />TO EXECUTE A DEVELOPER'S AGREEMENT FOR THE SMITH PREPARATORY SCHOOL <br />LOCATED AT 4921 SOUTH U.S. HIGHWAY 17-92 , IN CASSELBERRY, FLORIDA, <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Introduction: Consideration of approval of Resolution 22-3302 which provides for execution of the Smith <br />Preparatory School Developer's Agreement for the academy located at 4921 South U.S. Highway 17-92 is <br />requested. <br />
