Officer McDonald gave testimony that the property was reinspected and found to remain in violation on <br />November 18, 2021. The City requested a correction date of December 9, 2021. If no compliance by <br />December 9, 2021, then a fine of $200.00 per day should then be imposed for each day of non-compliance <br />thereafter. The City requests a subsequent hearing date of December 16, 2021, to determine compliance. <br />The Special Magistrate asked if there was anyone present to speak to this case, there was no one present. <br />The Special Magistrate made a finding that CE -21-001012, located at 913 Turtle Mound Dr., was in <br />violation of the City Code Sections as listed on the notice of code violation, based on testimony and <br />evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the <br />violations by 1:00 P.M. December 9, 2021. If there is no compliance by December 9, 2021, then a fine of <br />$200.00 per day will be imposed for each day the property remains in non-compliance. A subsequent <br />hearing will be held on December 16, 2021, to determine if compliance has been achieved. <br />SUBSEQUENT CASE -NOT IN COMPLIANCE <br />CE -21-000045 526 E Foothill Wav <br />• City code 3-10.c.1 & 2 Outdoor/open air storage -Residential <br />• City code 3-10.3.c.1 Overgrowth, weeds, trash, and debris <br />Officer Acevedo advised that case 21-000045 located at 526 E Foothill Way., was not in compliance by the <br />date set by the Magistrate and fines should be imposed. <br />The Special Magistrate advised that in addition to Officer Acevedo's testimony, she also had affidavit of <br />non-compliance from Officer Acevedo, indicating the property was not in compliance. Based upon <br />testimony and the affidavit, it was found that the property located at 526 E Foothill Way. was not in <br />compliance and fines should be imposed. <br />CE -21-000309 715 Benedict Wav <br />• City Code 1-4.3.a, No building permit <br />Officer McDonald advised that there has been an issue between the contractors, and this is now impacting <br />the homeowner. <br />The Special Magistrate tabled this case to be heard at a future hearing <br />CE -21-000401 381 Brittany Cir. <br />• City code 3-10.3.a.4, roofs, gutters, downspouts maintenance <br />• City code 2-7.10.a Fence permit required <br />Officer Acevedo advised that case 21-000401 located at 381 Brittany Cir., was not in compliance by the <br />date set by the Magistrate and fines should be imposed. <br />The Special Magistrate advised that in addition to Officer Acevedo's testimony, she also had affidavit of <br />non-compliance from Officer Acevedo, indicating the property was not in compliance.
