First Reading of Ordinance 22-1563 — Adding a Property Rights Element into the <br />City's Comprehensive Plan (LPA 21-01) <br />The City Clerk read Ordinance 22-1563 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY COMPREHENSIVE PLAN BY ADDING A PROPERTY RIGHTS ELEMENT IN <br />ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to first reading of Ordinance 22-1563 <br />was advertised in the Orlando Sentinel on Thursday, January 13, 2022. <br />Staff Presentation: Community Development Director Chris Bowley stated that Ordinance 22-1563 <br />amends the City's Comprehensive Plan to add Section 11 Property Rights Element in accordance with <br />Florida Statutes. Section 163.3167 of the Florida Statues requires the City to maintain a comprehensive <br />plan to guide its future growth and development. Furthermore, the Florida Statutes outline the required <br />elements that must be included in every comprehensive plan in Section 163.3177. In 2021 the Florida <br />Legislature and Governor approved an amendment to Section 163.3177 of the Florida Statutes to require <br />that "each local government shall include in its comprehensive plan a property rights element to ensure that <br />private property rights are considered in local decision making." While the Growth Management Act and <br />subsequent future land use elements are designed to address private property rights mandated by the Florida <br />Statutes, these additional legislative changes require an amendment to the City's Comprehensive Plan to <br />further define state land use law. The proposed amendment will be added as Section 11 to the City's <br />Comprehensive Plan. The Property Rights Element was developed in accordance with the requirements <br />outlined in Florida Statute 163.3177(6)(i) and consists of one goal, objective, and policy. Adoption of the <br />
