After those <br />three false alarms, the penalty status would again apply. <br />Budget Impact: There is no budget impact. <br />Recommendation: The City Manager and the Finance Director recommended adoption of Ordinance 21- <br />1561 on second reading. <br />Public Hearing: Vice Mayor Busch stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 21-1561. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 21-1561. Vice Mayor Busch closed the public hearing relative to <br />Ordinance 21-1561. <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 21-1561 on second and <br />final reading, as presented. Motion was seconded by Commissioner <br />Meadows. Motion carried unanimously by voice vote 4-0. <br />12. OTHER ITEMS <br />A. Amendment No. 1 to Supplemental Agreement No. 1 with Wharton -Smith, Inc. for <br />a Guaranteed Maximum Price to Construct Secret Lake Park and Related Budget <br />Amendment #22-014 Special Budgetary Rollover <br />Staff Presentation: Deputy Public Works Director/City Engineer Kelly Brock stated that approval of <br />Amendment No. 1 to Supplemental Agreement No. 1 to the Contract Agreement with Wharton -Smith, Inc. <br />for Construction Manager at Risk (CMAR) for Parks Construction Projects for a Guaranteed Maximum <br />Price (GMP) in the amount of $3,121,530.00 to construction project PW 1907 Secret Lake Park <br />Improvements and related Budget Amendment #22-014 is requested. (Ref. SOQ-2021-0715) On March <br />22, 2021 the City Commission approved Supplement Agreement No. 1 with Wharton -Smith, Inc. to provide <br />preconstruction services for Secret Lake Park, including assistance during the design process and <br />development of a Guaranteed Maximum Price (GMP). Final design of Secret Lake Park has been <br />completed and Wharton -Smith, Inc. has now developed a GMP proposal. The GMP being proposed, <br />inclusive of bid alternates, is $3,121,530.00. The GMP includes Owner Direct Purchases (ODP), which <br />will yield sales tax savings; however, the total amount of ODP's has not yet been determined. The GMP <br />also includes $112,676.00 in contingency funds (subject to approval by the City Manager), which may be <br />used to cover unanticipated additional work if needed. Due to concerns over material and labor pricing, <br />the boardwalks, fishing pier, and milling/resurfacing of the basketball court were broken out as bid <br />alternates. Staff recommends including these in the GMP award, as overall the project is within the <br />available budget left over from Fiscal Year 2020-2021 (FY21). The GMP is above the bond estimate for <br />this project; however, with the combination of General Fund from FY21 already devoted to this project, as <br />well as the $200,000 in funding from the federal Land and Water Conservation grant there is more than <br />enough budget available from FY21 that is proposed to be rolled into FY22. Dr. Brock then gave an <br />overview of key components of the park, and staff and the consultant's efforts to achieve cost savings on <br />the project. <br />
