CASSELBERRY CITY COMMISSION <br />Minutes of November 15, 2021 — Regular Meeting_ <br />Page 15 of 26 <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1560 <br />was advertised in the Orlando Sentinel on Thursday, November 4, 2021. <br />Staff Presentation: Community Development Director Chris Bowley stated that adoption of Ordinance <br />21-1560 provides for amending Chapter 1, General Administration, Section 1-4.3(D), Schedule of Building <br />Permit Fees, by updating building fees and providing for addressing fees. At first reading questions had <br />arisen regarding where the fee for research of records came from. Those fees are already in the Land <br />Development Code, and staff just carried those over and assigned a flat fee. They are not related to any <br />public records request, so the language related to that was struck between first and second reading. Also, <br />there was a question about where applications for HVAC fit in the fee structure, and it was determined to <br />be a mechanical item and was placed with electrical, plumbing and gas and was added to the ordinance. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 21-1560, amending Chapter 1, General Administration, Section 1-4.3(D), Schedule of <br />building permit fees, on second and final reading <br />Public Hearing: Vice Mayor Busch stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 21-1560. Vice Mayor Busch opened the floor for public participation. No <br />one came forward to address Ordinance 21-1560. Vice Mayor Busch closed the public hearing relative to <br />Ordinance 21-1560. <br />MOTION: Commissioner Aramendia moved to adopt Ordinance 21-1560 on second and <br />final reading, as presented. Motion was seconded by Commissioner <br />Meadows. Motion carried unanimously by voice vote 4-0. <br />B. Second Reading of Ordinance 21-1561 — Amending Chapter 34 False Alarms <br />The City Clerk read Ordinance 21-1561 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 34, <br />ARTICLE II, DIVISION 2, SECTION 34-38 FALSE ALARMS OF THE CODE OF ORDINANCES <br />OF THE CITY OF CASSELBERRY, FLORIDA TO CHANGE THE TIMING OF WHEN FALSE <br />ALARM SERVICE FEES ARE CHARGED; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1561 <br />was advertised in the Orlando Sentinel on Thursday, November 4, 2021. <br />Staff Presentation: City Manager Randy Newlon stated that Ordinance 21-1561 amends and restates <br />Chapter 34, Article I1, Division 2, Section 34-38, False Alarms for the purpose of clarification of wording. <br />City Code currently provides that the owner of an alarm system is given a grace period of six months with <br />three false alarms with no penalty. However, each alarm after that is subject to a fee of $100 for each <br />occurrence. However, the Code language was not clear at what point does the alarm system owner again <br />get the benefit of that grace period. Therefore, the Code is being modified with this ordinance to provide <br />
