CASSELBERRY CITY COMMISSION <br />Minutes of October 11, 2021 — Regular Meeting <br />Page R of 17 <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO FIRE AND <br />RESCUE IMPACT FEES, AMENDING PART II, CODE OF ORDINANCES, CHAPTER 53, <br />IMPACT FEES, SECTION 53-5, FEES IMPOSED, TO REVISE AND UPDATE FIRE AND <br />RESCUE IMPACT FEES IN ACCORDANCE WITH THE FIRE AND EMERGENCY MEDICAL <br />SERVICES INTERLOCAL AGREEMENT BETWEEN SEMINOLE COUNTY AND THE CITY <br />OF CASSELBERRY; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1556 <br />was advertised in the Orlando Sentinel on Thursday, September 30, 2021. <br />Staff Presentation: Community Development Director Chris Bowley stated that approval of Ordinance <br />21-1556 amending fire and rescue impact fees in accordance with the Fire and Emergency Medical Services <br />Interlocal Agreement between Seminole County and the City of Casselberry is requested. He then gave a <br />brief overview, reminding the City Commission that two public workshops had been held in August <br />regarding this issue which were required because the County's fees had been increased more than 50%, <br />and tonight was the second and final reading of the ordinance which would complete the Interlocal <br />Agreement obligation that the City has to Seminole County to adopt their increased fire rescue impact fees. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 21-1556 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 21-1556. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 21-1556. Mayor Henson closed the public hearing relative to <br />Ordinance 21-1556. <br />MOTION: Vice Mayor Busch moved to adopt Ordinance 21-1556 on second and final <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Motion carried unanimously by voice vote 5-0. <br />B. Second Reading of Ordinance 21-1557 — Amending Chapter 94 Waterways <br />The City Cleric read Ordinance 21-1557 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 94, <br />"WATERWAYS", OF THE CODE OF ORDINANCES TO UPDATE TO COMPORT WITH <br />STATE LAW, TO ADD NEW DEFINITIONS AND REMOVE OBSOLETE DEFINITIONS, TO <br />CLARIFY THE AUTHORITY OF THE CITY, TO UPDATE REGULATIONS FOR WATERWAY <br />CONTROL AND THE PERMITTING REQUIREMENTS FOR CONSTRUCTION ON LAKE <br />BOTTOMS AND MOORING STRUCTURES, TO ADD A PROCESS FOR THE REMOVAL OF <br />PUBLIC HAZARDS, TO PROHIBIT ABANDONED OR DERELICT VESSELS OR <br />WATERCRAFT AND TO ADD AN ENFORCEMENT PROCESS, AND TO ADOPT CHAPTER <br />327 OF THE FLORIDA STATUTES FOR THE REGULATION AND OPERATION OF VESSELS <br />
