Second Reading of Ordinance 21-1558 — Amending Chapter 2 Administration <br />Lien Reduction Procedures <br />The City Cleric read Ordinance 21-1558 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART II, CODE <br />OF ORDINANCES, CHAPTER 2, ADMINISTRATION, ARTICLE IV, BOARDS, COMMITTEES, <br />AND COMMISSIONS, DIVISION 2, CODE ENFORCEMENT BOARD, SECTION 2-158, <br />APPLICATION FOR SATISFACTION OR RELEASE OF CODE ENFORCEMENT LIENS, TO <br />MODIFY PROCEDURES FOR THE REDUCTION, SATISFACTION, AND RELEASE OF CODE <br />ENFORCEMENT LIENS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1557 <br />was advertised in the Orlando Sentinel on Thursday, September 30, 2021. <br />Staff Presentation: Community Development Director Chris Bowley stated that adoption of Ordinance <br />21-1558 which provides for aiTieriding procedures for handling the reduction, satisfaction, and release of <br />code enforcement liens in order to streamline the process and establish additional detailed objective criteria <br />for consideration of applications for the reduction, satisfaction, and release of such liens is requested. He <br />explained that the City of Casselberry currently has provisions for the reduction, satisfaction or release of <br />recorded code enforcement liens placed on real property in the City as a result of violations of City Code. <br />The City's goal is to achieve compliance in code enforcement issues, which is preferred over the lien and <br />financial penalty side. The City's Code Enforcement Special Magistrate is the one who determines and <br />sets a fine when appropriate. <br />Currently, the City has both a resolution and an ordinance which address code compliance issues; however, <br />the ordinance is somewhat cumbersome and rarely used, and the resolution is utilized more often as it is <br />tied to a real estate transaction. The resolution gives the City Manager the authority to review a lien <br />reduction request and make that determination. Ordinance 21-1558 is an effort to adopt the more <br />streamlined process currently being used in real estate matters, giving the City Manager the ability to review <br />and assess requests for lien reductions, while providing potential to go the Special Magistrate for appeal. <br />Ordinance 21-1558 was approved on first reading on September 13, 2021. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 21-1558 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 21-1558. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 21-1558. Mayor Henson closed the public hearing relative to <br />
