Thomas Kirk, HOA President, 2508 Barbados Dr., Mr. Kirk advised there is an elderly woman who lives <br />next to this property and the carport structure borders the other property and there is a concern that there <br />could be injuries should this carport fall. The Special Magistrate asked if Mr. Kirk thought this was in <br />danger of falling. Mr. Kirk stated yes and agrees with the inspector. <br />The Special Magistrate made a finding that CE -21-000387, located at 2639 Cayman Way, was in violation <br />of the City Code Sections as listed on the notice of code violation, based on testimony and evidence <br />provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by <br />1:00 P.M. August 13, 2021. If there is no compliance by August 13, 2021, then a fine of $250.00 per day <br />will be imposed for each day the property remains in non-compliance. A subsequent hearing will be held <br />on August 19, 2021 to determine if compliance has been achieved. <br />CE -21-000206 1018 Wolf TH. <br />• City Code 2-7.10.a Fence permit required <br />Supervisor Campbell provided testimony and read case information into the record. The City requested a <br />correction date of August 29, 2021. If no compliance by August 29, 2021, then a fine of $75.00 per day <br />should then be imposed for each day of non-compliance thereafter. The City requested a subsequent hearing <br />date of September 16, 2021 to determine compliance. The Special Magistrate asked if there was anyone <br />wishing to speak to this case, a representative for the property owner was present to speak to this case. <br />Robert Vazquez, representative for Declan Feeney, 1488 Seminola Blvd., advised that the plan was to repair <br />the fence but more of the slats started coming off. Unfortunately, a permit was not pulled and it was replaced <br />in the same spot it was before. There was discussion about needing a survey or not. Mr. Campbell advised <br />a survey would be needed. <br />The Special Magistrate made a finding that CE -21-000206, located at 1018 Wolf Trl., was in violation of <br />the City Code Sections as listed on the notice of code violation, based on testimony and evidence provided <br />by the Code Enforcement Officer. It was ordered that the respondent shall cure the violation by 1:00 P.M. <br />August 29, 2021. If there is no compliance by August 29, 2021, then a fine of $75.00 per day will be <br />imposed for each day the property remains in non-compliance. A subsequent hearing will be held on <br />September 16, 2021 to determine if compliance has been achieved. <br />LEIN REDUCTION REQUEST <br />CE -21-000060 1531 E Altamonte Dr. <br />Supervisor Campbell advised that the property was now in compliance and the property owner was present <br />to speak. The City was going to try to hold off on recording the order with Seminole County. The Special <br />Magistrate made a clarification, that she did not instruct the City when or when not to file the order and the <br />City has no legal obligation to not file. <br />Mr. Campbell advised that the City was trying to hold off on filing the order, as the owner was working <br />with permitting to obtain the permit, so this case would be in compliance. The order was filed along with <br />other orders that were to be filed with Seminole County. The property is now in compliance and was out of <br />compliance for 50 days, there was lag in time in the review process and the owner did not have control over <br />that. There is no way to figure the exact number of days that were beyond control of the owner, in good <br />faith the City would say 25 days, rather than 50 days as Mr. Judge has no control over review time. <br />3 <br />
