The Special Magistrate asked if there was <br />anyone wishing to speak to this case, the property owner and HOA president were present to speak to this <br />case. <br />Mary Luciano, property owner 2638 Cayman Way gave testimony. Ms. Luciano advised she has no kitchen <br />and is living at a hotel at this time, and she does not know who put the blue tarp on her roof. Ms. Luciano <br />advised she has been out of the country for a year and a half for family problems. Ms. Luciano spoke with <br />the HOA President about the violation and said she could not make the repairs overnight. <br />The Special Magistrate asked what contractors or assistance Ms. Luciano has already obtained. Ms. Luciano <br />stated she had not obtained any assistance yet. The Special Magistrate asked what violations were already <br />corrected by Ms. Luciano. Ms. Luciano stated she removed the tarp and cleaned the yard. The Special <br />Magistrate asked when Ms. Luciano could have the violations cured. Ms. Luciano advised the end of August <br />would be good. <br />The Special Magistrate asked Supervisor Campbell if the porch was clear. Mr. Campbell described photos <br />dated July 14, 2021, furniture, boxes, and the items are really items that should be stored indoors. The tarp <br />referred to was indicative of a tarp that had been there for a long time. The Special Magistrate advised that <br />the property looks to have been in disrepair for a long time. <br />Thomas Kirk, HOA President, 2508 Barbados Dr., advised that the HOA has received nothing but <br />complaints about this property and presented a copy of an email from 2015, where this property has had <br />issues. The Special Magistrate entered into record and email from Carlos Bauer to Brenda Jones on <br />September 15, 2015, discussing the property, entered as exhibit A. Mr. Kirk advised that the HOA has paid <br />several times to clean up the outside of this property. The Special Magistrate asked how much was spent <br />by the HOA on this property. Mr. Kirk did not have the total spent with him; last account was $750. Mr. <br />Kirk advised this is a townhome community and neighbors have complained about field mice and rats that <br />are getting in through Ms. Luciano's house and coming down the road. <br />Supervisor Campbell advised that the illegal structure referred to is an active case and is currently running <br />fines. <br />The Special Magistrate made a finding that CE -21-000386, located at 2638 Cayman Way, was in violation <br />of the City Code Sections as listed on the notice of code violation, based on testimony and evidence <br />provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by <br />1:00 P.M. September 13, 2021. If there is no compliance by September 13, 2021, then a fine of $200.00 per <br />day will be imposed for each day the property remains in non-compliance. A subsequent hearing will be <br />held on September 16, 2021 to determine if compliance has been achieved. <br />CE -21-000387 2639 Cayman W� <br />• City Code 3-10.2. The City requested a <br />correction date of September 13, 2021. If no compliance by September 13, 2021, then a fine of $250.00 <br />per day should then be imposed for each day of non-compliance thereafter. The City requested a <br />subsequent hearing date of September 16, 2021 to determine compliance. The Special Magistrate asked if <br />there was anyone wishing to speak to this case, the HOA president was present to speak to this case. <br />The Special Magistrate asked if the structure seemed to be in danger of falling. Supervisor Campbell <br />stated he would say yes. <br />
