Jen Nix, Assistant City attorney advised that it was not really the City's intent to record the order and <br />because Mr. Judge was present and on the agenda was to let him file a lien reduction. The Special Magistrate <br />stated the compliance dates are not the issue and not what the Magistrate is dealing with, but rather the <br />suggestion to make a recommendation to start the process and will not have to wait for the next hearing. <br />The Special Magistrate accepted the lien reduction request. <br />Mr. Campbell advised that the City would recommend a reduction of the lien from $5,000 to $2,500. <br />was the date. Mr. Judge contracted with a company on January 29t' and was working with the City to get <br />the permit and was not dragging his feet. Mr. Judge stated to the Magistrate he was asking for a complete <br />reduction. <br />The Special Magistrate stated the City was being very generous in recommending to reduce to fifty percent. <br />The case dragged on for quite a while and while the property owner felt everything was beyond his control, <br />the City did not create a violation on the property. There has also been a lot of staff time involved having <br />come before the City on multiple occasions and at the owners' request was tabled multiple occasions. Some <br />of the money spent by the City must be compensated and when people violate City code there are <br />consequences to it. <br />The Special Magistrate made a recommendation to the City Commission reduce the lien for case number <br />21-000060, located at 1531 E Altamonte Dr be reduced from $5,000 to $2,500. <br />SUBSEQUENT CASES <br />CE -21-000019 2647 Exuma Wa <br />City Code 3-10.3.a.4- Roofs, gutters, down spout maintenance <br />City Code 3-10.2.1.d- Exterior walls <br />City Code 3-10.9.f- Unlicensed and/or inoperable vehicles <br />Supervisor Campbell advised this was being withdrawn from hearing and would not be heard. <br />CE -21-000162 850 SR 436 <br />• City Code 1-4.3 No building permit <br />Supervisor Campbell advised that the above property was not in compliance by the date set by the Special <br />Magistrate and fines should be imposed. <br />The Special Magistrate advised that in addition to Officer Campbell's testimony, she also had and affidavit <br />of non-compliance from Officer McDonald, indicating the property was not in compliance. Based upon <br />testimony and the affidavit, it was found that the property located at 850 SR 436 was not in compliance and <br />a fine of $200.00 per day should be imposed. <br />NEW CASES <br />CE -21-000190 691 Bayou Dr. <br />City Code 1-4.3, No building permit <br />Supervisor Campbell provided testimony and read case information into the record. The City requested a <br />correction date of August 29, 2021. If no compliance by August 29, 2021, then a fine of $250.00 per day <br />
