Christopher Kangas, property owner of 460 Lowndes Sq. gave testimony. When the notice was first received in
<br />August (2020) repairs were made and he did not realize a permit was needed. Existing fence panels and post in the
<br />same locations were replaced, not in new locations. Mr. Kangas advised he is currently going through a divorce and
<br />not living at the home and the finances are just not there to replace the whole fence.
<br />The Special Magistrate asked if there was a pool, Mr. Kangas stated there is a pool and stated he should be able to
<br />complete the fence work in three months.
<br />The Special Magistrate made a finding that CE -20-002211, located at 460 Lowndes Sq., was in violation of the City
<br />Code Section as listed on the notice of code violation, based on testimony and evidence provided by the Code
<br />Enforcement Officer. It was ordered that the respondent shall cure the violation by obtaining a building permit for
<br />all fence sections by 1:00 P.M. March 20, 2021. Fence sections with gaps larger than two inches must be replaced
<br />by 1:00 P.M. March 20, 2021 (section is the portion of fence between two posts in the ground). The remainder of
<br />the deteriorated fence must be replaced by 1:00 P.M. May 19, 2021. A Hearing will be held on April 15, 2021, 6:30
<br />P.M. for violations required to be cured by March 20, 2021 and/or on May 20, 2021, 6:30 P.M. for violations
<br />required to be cured by May 19, 2021 to determine if compliance has been achieved.

<br />determine compliance. The Special Magistrate asked if there was anyone wishing to speak to this case, there was
<br />no one present.
