Waiver request from Section 3-15.6.A - Design and specifications for parking and loading areas: To <br />allow 13 of the 40 proposed parking spaces at a dimension of 10 ft. by 18 ft. Staff supports this request. <br />Conditions of Approval <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />2. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />3. All of the above conditions shall be fully and faithfully executed, or the site plan shall become null and <br />void. <br />A brief discussion ensued regarding the location of the 10 ft. by 18 ft. parking spaces, proposed hardscape <br />for the site, and traffic on Button Road. <br />Mr. Phillips asked the applicant to come forward. Mr. Kevin Hebert, 964 Lake Baldwin Lane, #200, Orlando, <br />Florida came forward. Mr. Hebert stated there is no hardscape proposed for the site. A brief discussion ensued <br />regarding the various parking space sizes and the proposed completion date for the project. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address SPR 20-11. Mr. Hale made a motion that the Planning and <br />Zoning Commission approve case number SPR 20-11 for a parking lot for the Aviation Institute based on the findings <br />of fact and conclusions of the staff report dated December 16, 2020 including the waiver, the three (3) conditions of <br />approval and Attachments A and B. Ms. Divita seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: LPA 20-11: Tree Removal Process Ordinance. An ordinance to amend Article XIV, <br />Tree Protection, Section 3.14.3, Permit Required for Removal, and Section 3-14.8, Violations, Waivers and <br />Appeals, of the Unified Land Development Regulations. <br />Mr. Chris Bowley, Community Development Director, reviewed the information provided in staffs <br />memorandum dated December 16, 2020 along with the revised draft ordinance that was distributed to the City of <br />Casselberry Planning and Zoning Commission (a copy of the revised ordinance is attached and made a part of the <br />minutes). Mr. Bowley explained that this ordinance defines the exemption process for tree removal and provides a <br />definition for residential. <br />A general discussion ensued regarding the City's current tree removal process that includes tree <br />replacement, tree removal permit fee, and tree removal exemptions that require no tree replacement. <br />
