Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />December 16, 2020 <br />Page 5 <br />Mr. Bowley requested the Planning and Zoning Commission vote on this item tonight. He explained the City <br />Manager requested this item be presented to the City Commission at the January 11 workshop. Mr. Bowley stated <br />this item would be brought back to the City Commission on January 25 for first reading and a second reading in <br />February. <br />In response to the Commission's question, Mr. Bowley explained that the ordinance provides the following: <br />1. Recognizes State and Local exemptions <br />2. Defines residential and non-residential <br />3. Using the State's definition of International Society of Arboriculture (ISA) <br />4. Use of the International Society of Arboriculture Basic Tree Risk Assessment Form <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address LPA 20-11. Mr. Hale made a motion that the Planning and <br />Zoning Commission provide a favorable approval to the City Commission for case number LPA 20-11 and the <br />proposed Tree Removal Process Ordinance based on the staff report and the testimony dated December 16, 2020, <br />the updated Attachment A and Attachment B as presented in the staff report. Mr. Bakalla seconded the motion. The <br />motion passed with a majority vote with Mr. Phillips casting the dissenting vote. <br />Eighth Item of Business: Orientation Presentation from the City Attorney. Quasi -Judicial Proceedings; <br />Developing Good Habits, <br />Ms. Neysa Borkert, Assistant City Attorney, reviewed a PowerPoint presentation on Quasi -Judicial <br />Proceedings. Ms. Borkert provided an overview of quasi-judicial proceedings and the role of the Planning and <br />Zoning Commission. <br />A brief discussion ensued regarding an additional packet of information that was provided to the new <br />Commissioners. It was decided that staff would email the additional information to the Planning and Zoning <br />Commission on Thursday. <br />Ninth Item of Business: Orientation Presentation from the Community Development Director. The City's <br />Local Planning Agency on Land Use Matters. <br />Mr. Chris Bowley, Community Development Director, reviewed a PowerPoint presentation on the City's <br />Local Planning Agency's role in land use matters. Mr. Bowley explained the responsibilities of the Local Planning <br />Agency, the Comprehensive Plan and the Unified Land Development Regulations. <br />
