Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />September 8, 2021 <br />Page 3 <br />In response to the Commission's question regarding the two suite numbers listed in the staff report, Mr. <br />Jordan -Madden said the applicant has not decided which suite would be the primary address and it may require <br />readdressing the property. He said as it currently stands those are the two (2) suites they have selected for their <br />business. <br />Mr. Phillips said the applicant was not present. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address CU 21-19. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve case number CU 21-19, medical day care facility at 242 State Road 436, the recommendation <br />is based on the findings of fact and conclusions of the staff report dated September 8, 2021, the ten (10) conditions <br />and Attachments A - C. Ms. Saporito seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 21.16: Conditional Use for Fishing Pier and Impervious Surface Ratio. A <br />conditional use request to allow a fishing pier and site plan modifications creating greater than 30 percent <br />impervious surface ratio at Secret Lake Park located at 200 Triplet Lake Drive. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated <br />September 8, 2021 to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff <br />recommends case number CU 21-16 be approved with staffs conditions, based upon the staff report and the <br />testimony and evidence presented, that the request meets the applicable provisions of the Unified Land Development <br />Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff <br />report. The conditions of approval are as follows: <br />All Public Works conditions must be met. These conditions include the following: <br />a) A building permit will be required for the proposed dock. The following are conditions and/or items <br />that will apply to said permit. This list is not necessarily exhaustive: <br />i. The structure may require a permit through Florida Department of Environmental Protection <br />(FDEP). Evidence of an FDEP permit or exemption/self-certification must be provided with a <br />building permit submittal. NO FILL may be imported without compensating storage as part of the dock's construction for <br />the portion that lies within the Special Flood Hazard Area (SFHA), also known as the 100 -year <br />floodplain. <br />iii. When this structure exceeds four feet in width, the City's Unified Land Development Regulations <br />(ULDRs) with regard to Environmental Protection will apply to this structure. In particular, <br />Section 3-11.5 Lakeshore Protection will apply. <br />
