Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />September 8, 2021 <br />Page 2 <br />Fifth Item of Business: CU 21-19: Conditional Use for Medical Day Care Facility. A conditional use request to <br />operate a medical day care facility located at 242 State Road 436. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated <br />September 8, 2021 to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff <br />recommends that case number CU 21-19 be approved with staffs conditions, based upon the staff report and the <br />testimony and evidence presented, that the request meets the applicable provisions of the Unified Land Development <br />Regulations and is consistent with the Comprehensive Plan as per the written findings contained within the staff <br />report. He said the conditions of approval are as follows: <br />1. The conditional use shall be limited to the location of 242 and 246 State Road 436. <br />2. There shall be no outside display or storage of goods, materials, or services. <br />3. Business vehicles shall not be parked in the parking spaces closest to the building frontage when not in <br />use; such spaces shall be reserved for regular customers. <br />4. Prior to implementing the business use, the primary entrance of the business shall provide all <br />necessary ADA accommodations including but not limited to ramps, parking spaces, and crosswalks as <br />given by the Florida Building Code — Accessibility. <br />5. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />6. There shall be no stacking of vehicles for the pick-up or drop-off of guests. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. The conditional use shall commence within one year of approval. <br />9. A new conditional use application shall be required if the use should cease for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Jordan -Madden stated that the applicant was not present. A brief discussion ensued regarding the <br />overnight parking of the business vehicles. Ms. Neysa Borkert, Assistant City Attorney, explained that conditional <br />uses are specific to a specific use and a specific property. She said it is called a "conditional use" because it has <br />conditions attached to the approval. <br />Ms. Borkert questioned the number of conditions of approval. She said eight (8) conditions of approval were <br />read into the record; however, the staff report lists ten (10) conditions of approval. Mr. Jordan -Madden said the ten <br />(10) conditions of approval listed in the staff report are correct. <br />A general discussion ensued regarding distance separation for school -type uses locating at a location that <br />has an existing distance separation type business. Ms. Borkert explained that the state licensing for this medical day <br />care facility would determine if a distance separation would be required. <br />A brief discussion ensued regarding pick-up/drop-off procedure and handicapped parking spaces. <br />
