Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 9, 2021 <br />Page 4 <br />6. The conditional use shall commence within one year of approval. <br />7. A new conditional use application shall be required if the use should cease for more than 90 days. <br />8. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />In response to the Commission's question, Mr. Jordan -Madden explained that conditional use approval is <br />required in both CG zoning and the Community Redevelopment District. A lengthy discussion ensued regarding the <br />potential safety of the guests if dropped off and picked up in front of the building and possible modifications to the <br />parking lot, consistency of language for parking in the fire lane, and modifying condition number 2. <br />Mr. Phillips asked the applicant to come forward. Mr. Mohamed Hudda, 1114 Arbor Glen Circle, Winter <br />Springs, Florida came forward. In response to the Commission's question, Mr. Hudda said that the facility would be <br />private pay; however, in the future it may accept Medicare and Medicaid. He said adult day care is a cheaper <br />alternative to home health care or living in an assisted living facility. He said it provides an opportunity for guests to <br />socialize with their peers and to participate in various activities. <br />In response to the Commission's question, Mr. Hudda stated that the average guest visit is five (5) hours a <br />day. Mr. Hudda said he requested the property owner to relocate the wheelchair access and modify three (3) parking <br />spaces to two (2) spaces with a crosswalk between the two parking spaces to the building. He said the adult day <br />care would provide transportation services for its guests and it would use the modified parking spaces for drop- <br />off/pickup of guests. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address CU 21-08. Ms. Divita made a motion that CU 21-08 be approved <br />based on the conditions, the staff report and the testimony and evidence presented, the conditions listed 1 - 8 with a <br />modification to condition 2 which will be rewritten to read: "There should be no stacking of vehicles for the pickup or <br />drop-off of guests. Guests must park in designated parking spots," and Attachments A, B and C. Ms. Saporito <br />seconded the motion. The motion passed unanimously by voice vote. <br />
