Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 9, 2021 <br />Page 3 <br />After a brief discussion regarding the waiver to the parking space size, Mr. Phillips asked the applicant to <br />come forward. Mr. David Morse, B & D Casselberry, LLC, 2221 Lee Road, Winter Park, Florida came forward. A <br />general discussion ensued regarding the type of shrubs being used adjacent to the drive through area. The <br />Commission expressed a concern that the shrubs may impair visibility in the drive through area. Mr. Morse said from <br />his experience, the developers want to maintain a manageable landscaping and provide visibility to the building. <br />A general discussion ensued regarding the possible travel path staff would use to deliver food to the pickup <br />parking spaces. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address SPR 21-06. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve case number SPR 21-06, a major site plan review for 1391 State Road 436 in the Casselberry <br />Center based on the findings of fact and conclusions of the staff report dated June 9, 2021, the waiver, the six (6) <br />conditions of approval and Attachments A - E. Mr. Bowman seconded the motion. The motion passed unanimously <br />by voice vote. <br />Sixth Item of Business: CU 21.08: 3385 S. U.S. Highway 17-92. A conditional use request to operate an adult <br />day care at 3385 S. U.S. Highway 17.92. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated June 9, <br />2021, to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends that <br />case number CU 21-08 be approved with staffs conditions, based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations <br />and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. Mr. <br />Jordan -Madden reviewed the following conditions of approval: <br />1. The conditional use shall be limited to the location of 3385 S US HWY 17-92 #133. <br />2. There shall be no stacking of vehicles for the pick-up or drop-off of guests. Guests should park and <br />walk into the business. <br />3. The business shall remain in complete compliance with all City, County and State requirements. <br />4. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />5. All applicable licenses and permits shall be obtained prior to the commencement of any business <br />activities at the site. <br />
