Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />June 9, 2021 <br />Page 2 <br />Fourth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Fifth Item of Business: SPR 21-06: Casselberry Center at 1391 SR 436. A major site plan request to redevelop <br />a portion of the subject property by constructing a ±2,442 sq. ft. restaurant with a drive through, a walk-up <br />ATM, as well as associated hardscape, landscaping, stormwater retention, and site lighting. <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in his memorandum dated June 9, 2021, to <br />the City of Casselberry Planning and Zoning Commission, Mr. Tardif said staff recommends that the Planning and <br />Zoning Commission approve case number SPR 21-06, based on the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is <br />consistent with the Comprehensive Plan as per the written findings in the staff report. Mr. Tardif reviewed the <br />following waiver and conditions of approval: <br />Waiver: <br />1. A waiver request to permit 8 of the 25 parking spaces (32%) on lot 1 to be reduced sized parking spaces <br />at 10 feet by 18 feet. <br />Conditions of Approval: <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />2. A tree bank payment of $16,450.00 must be submitted prior to the issuance of a Certificate of <br />Occupancy. <br />3. The walk-up ATM must adhere to all commercial design standards and sign regulations within the <br />ULDR. <br />4. The applicant must obtain a demolition permit for the removal of the existing building on site. <br />5. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />6. All of the above conditions shall be fully and faithfully executed, or the site plan shall become null and <br />void. <br />A brief discussion ensued regarding fencing in the utility access easement, design of the outdoor seating <br />area, height of shrubs adjacent to the drive through, and parking requirements for Lot 1 <br />In response to the Commission's question, Mr. Tardif explained that staff had discussions with the applicant <br />regarding providing parking spaces for quick service pickup. Staff wanted to ensure that the parking would <br />accommodate patrons at the site. He said if the applicant chose to designate spaces for quick service pickup, an <br />additional two (2) parking spaces would be required for general use. <br />
