Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />May 12, 2021 <br />Page 3 <br />In response to the Commission's question regarding the width of the driveway adjacent to the motel, it was <br />stated the width is 26 feet. <br />Mr. Phillips asked the applicant to come forward. Mr. Erik Madsen, Landon, Moree and Associates, Inc., <br />31622 US 19 North, Palm Harbor, Florida came forward. In response to the Commission's question regarding the <br />existing driveway on Oxford Road, Mr. Madsen stated that the driveway would remain basically the same. <br />A brief discussion ensued regarding the pedestrian access to the site, crosswalk design, designation of <br />parking for pickup service and interconnectivity of shopping centers. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address SPR 21-05, Mr. Hale made a motion that the Planning and Zoning <br />Commission approve SPR 21-05, a major site plan for Wendy's at 198 State Road 436, based on the findings of fact <br />and conclusions of the staff report dated May 12, 2021, the five (5) conditions of approval, and Attachments A — E. <br />Mr. Bowman seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 21-07: 134 N. Lost Lake Lane. A conditional use request to construct a residential <br />boat dock at 134 N. Lost Lake Lane. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated May 12, <br />2021 to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden stated that an amended <br />condition of approval was distributed to the Planning and Zoning Commission (a copy is attached and made a part of <br />the minutes). <br />Mr. Jordan -Madden said staff recommends that case number CU 21-07 be approved with staffs conditions, <br />based upon the staff report and the testimony and evidence presented, that the request meets the applicable <br />provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report. He reviewed the following conditions of approval: <br />1, All Public Works conditions must be met. These conditions include the following: <br />a. A building permit will be required for the proposed dock. The following are conditions <br />and/or items that will apply to said permit. This list is not necessarily exhaustive: <br />i. The structure may require a permit through Florida Department of Environmental <br />Protection (FDEP). Evidence of an FDEP permit or exemption/self-certification must be <br />
