Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />May 12, 2021 <br />Page 2 <br />Mr. Phillips stated the Chair was open for a motion on the approval of minutes for the meeting held on <br />Wednesday, April 14, 2021. Mr. Bakalla moved to accept the April 14, 2021 minutes. Mr. Bowman seconded the <br />motion. The motion passed unanimously by voice vote. <br />Fourth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Fifth Item of Business: SPR 21-05: Wendy's at 198 SR 436. A major site plan request to redevelop the subject <br />property by constructing a ±2,586 sq. ft. drive through restaurant along with associated hardscape, <br />landscaping, stormwater retention, and site lighting. <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in his memorandum dated May 12, 2021 to <br />the City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends that the Planning and <br />Zoning Commission approve case number SPR 21-05, based on the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is <br />consistent with the Comprehensive Plan as per the written findings in the staff report. He reviewed the following <br />conditions of approval: <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />2. A tree bank payment of $2,800.00 must be submitted prior to the issuance of a Certificate of <br />Occupancy. <br />3. The applicant must obtain a demolition permit for the removal of the existing building on site. <br />4. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />5. All of the above conditions shall be fully and faithfully executed, or the site plan shall become null and <br />void. <br />In response to the Commission's question regarding the tree bank contribution, Mr. Tardif explained that the <br />proposed development meets all of the landscaping requirements except for the landscape buffer requirements. He <br />explained that the site cannot accommodate any additional trees. <br />A general discussion ensued regarding determination of when a site needs to pay into the tree bank, <br />crosswalk design, pedestrian access to the site from Oxford Road, parking for food delivery services, and the number <br />of handicap parking spaces. <br />In response to the Commission's question, Mr. Tardif explained that the existing parking lot on the north side <br />of the development would remain the same due to existing access easements on the site. <br />
