NO FILL may be imported without compensating storage as part of the dock's <br />construction for the portion that lies within the Special Flood Hazard Area (SFHA), also <br />known as the 100 -year floodplain. <br />iii. Per Section 3-11.5 of the City's ULDR, Lakeshore Protection, the submittal should include <br />a plan for permanent native re -vegetation of the shoreline to bring it into compliance <br />with City Code and State Law. Per Section 94-6 of the City Code of Ordinances, this dock must be properly lit from sunset to sunrise to <br />show its overall length as it is proposed to extend further than 20 feet from the shoreline. <br />3. A building permit must be submitted within 180 days of the approval. <br />4, The dock must be kept in good condition. The conditional use shall become null and void if the dock <br />sustains damage or falls into disrepair and is not repaired or replaced within six months and is taken <br />before the Special Magistrate for the Code violation. <br />5. A new conditional use will be required if the size or dimensions of the dock is increased. <br />6. The site's numerical address must be clearly posted on the dock in an area that is visible from the <br />waterbody. <br />7. The applicant shall submit with the building permit application an executed Hold Harmless and <br />Maintenance Agreement with the City. <br />8. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question, Mr. Jordan -Madden stated the Planning and Zoning Commission <br />is approving the walkway, the dock, and the deck. <br />Mr. Jordan -Madden explained that the Casselberry Estate is in the process of modifying the estate and is <br />not able to sign off as the owner of the lake bottom. He explained that staff had discussions with the City Attorney <br />regarding ownership of the lake bottom and it was determined that this is a verified lakefront property. He said <br />lakefront properties are conferred special privileges that allows them access to the lake and it does not require <br />permission from the lake bottom owner to construct the dock. <br />Mr. Phillips asked the applicant to come forward. Mr. Robert Johnson, 134 N. Lost Lake Lane, Casselberry, <br />Florida came forward. There were no questions for the applicant. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address CU 21-07. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 21-07, residential dock at 134 N. Lost Lake Lane, based on the findings of fact and <br />
