Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />April 14, 2021 <br />Page 4 <br />A general discussion ensued regarding the existing driveway cut along Seminola Boulevard that was used <br />for the construction traffic for Phase 2, fencing around the school property, adjusting drop off/pickup times to offset <br />Seminole County school traffic and traffic stacking concerns on Seminola Boulevard, <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address SPR 21-01. Mr. Hale made a motion that the Planning and <br />Zoning Commission provide a favorable recommendation of approval to the City Commission for case number SPR <br />21-01, based on the findings of fact and conclusions of the staff report dated April 14, 2021, the testimony and <br />evidence presented, the four (4) conditions of approval, and Attachments A — F. Mr. Bowman seconded the motion. <br />The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 21.06: Wholesale Bakery at 110 Live Oaks Blvd. A conditional use request for a <br />wholesale bakery in the CG (Commercial General) zoning district and the Community Redevelopment <br />District, <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in staffs memorandum dated April 14, <br />2021 to the City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends that case <br />number CU 21-06 be approved with staffs conditions, based upon the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is <br />consistent with the Comprehensive Plan as per the written findings contained within the staff report. He said the <br />conditions of approval are as follows: <br />1. The conditional use shall be limited to the location of 110 Live Oaks Boulevard. Expansion of the tenant <br />space will require additional conditional use approval. <br />2. The business shall remain in complete compliance with all City, County, and State requirements. <br />3. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />4. The conditional use shall commence within 180 days of the approval. <br />5. The conditional use shall expire if the use is discontinued for more than 90 days. <br />6. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question, Mr. Tardif explained that the change in use process involves <br />reviewing the building code classification. He said the change in use would require review by the Building <br />Department and the Fire Department to ensure the site meets Code. <br />
