The motion passed unanimously by <br />voice vote. <br />Ninth Item of Business: CU 21-04: 1810 SR 436 Suites 124 128 132 136 and 140. A conditional use request to <br />serve beer, wine, and liquor for on-site consumption (4COP) at the Cue Phoria Billiards and Cafe located at 1810 <br />State Road 436 Suites 124, 128, 132, 136, and 140. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated March 10, 2021 <br />to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends that case number <br />CU 21-04 be approved with staffs conditions, based upon the staff report and the testimony and evidence presented, that <br />the request meets the applicable provisions of the Unified Land Development Regulations, and is consistent with the <br />Comprehensive Plan as per the written findings contained within the staff report. He said the conditions of approval are as <br />follows: <br />1. The conditional use shall be limited to the location of 1810 SR 436 Suites 124, 128, 132, 136, and 140. <br />Expansion of the tenant space will require additional conditional use approval. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. The hours of alcohol sales shall comply with the hours set forth in Section 10-2 of the City of Casselberry <br />Code of Ordinances. <br />5. The business shall remain in complete compliance with all City, County, and State requirements. <br />6. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />7. The conditional use shall commence within 180 days of the approval. <br />8. The conditional use shall expire if the use is discontinued for more than 90 days. <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Phillips asked the applicant to come forward. Mr. Faheem Zia, 1810 State Road 436, Suite 132, Winter Park, <br />Florida came forward. In response to the Commission's concern, Mr. Zia explained that the space between the two <br />business uses is sealed so that the smoke would not escape from the pool hall portion of the business. He said he'would <br />also install a filtration system to handle the smoke. Mr. Zia explained that he plans to open a high-end cigar lounge in the <br />additional space. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />After a brief discussion regarding the outside seating area, Mr. Phillips asked for a motion to address CU 21-04. <br />Ms. Divita made a motion that the Planning and Zoning Commission approve case number CU 21-04 with staffs conditions, <br />
