A conditional use request to serve beer, wine, and <br />liquor for on-site consumption (4COP-SRX) at the Santa Rosa Mexican Restaurant located at 1436 SR 436 Suite <br />1064. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated March 10, 2021 <br />to the City of Casselberry Planning and Zoning Commission, Mr. Jordan -Madden said staff recommends that case number <br />CU 21-03 be approved with staffs conditions, based upon the staff report and the testimony and evidence presented, that <br />the request meets the applicable provisions of the Unified Land Development Regulations, and is consistent with the <br />Comprehensive Plan as per the written findings contained within the staff report. He said the conditions of approval are as <br />follows: <br />1. The conditional use shall be limited to the location of 1436 SR 436 Suite 1064. Expansion of the <br />tenant space will require additional conditional use approval. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors or confined to outdoor <br />seating areas that have been approved as part of the official site plan. <br />3. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. The hours of alcohol sales shall comply with the hours set forth in Section 10-2 of the City of <br />Casselberry Code of Ordinances. <br />5. The business shall remain in complete compliance with all City, County, and State requirements. <br />6. There shall be no outside display or storage of goods, materials, services, or vehicles. <br />7. The conditional use shall commence within 180 days of the approval. <br />8. The conditional use shall expire if the use is discontinued for more than 90 days. <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />A brief discussion ensued regarding outdoor seating for the restaurant and allowing package sales during the <br />pandemic. <br />Mr. Phillips asked the applicant to come forward. Ms. Tania Mendez, 2324 Coawood Court, Maitland, Florida <br />came forward. Ms. Mendez said the business is relocating to a larger space with higher visibility. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Mr. Dean Fathelbab, Economic Development Planner, stated that this business is approved for the City's Oil and <br />Grease Interceptor Program. <br />Mr. Phillips asked for a motion to address CU 21-03. Ms. Campbell made a motion that the Planning and Zoning <br />Commission approve case number CU 21-03 with staffs conditions, based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations, is <br />consistent with the Comprehensive Plan as per the written findings contained within the staff report including the nine (9) <br />
