Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 10, 2021 <br />Page 5 <br />Ms. Grace Gilford, 217 Lake Ellen Drive, Casselberry, Florida came to speak in opposition of the request. Ms. <br />Gilford expressed a concern that the proposed development would impact the quality of the lake. <br />Mr. Phillips asked for a motion to address CU 21-05. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve case number CU 21-05, the Emergency Veterinary Clinic located at 3352 South US Highway 17-92. <br />The recommendation is based on the findings of fact and conclusions of the staff report dated March 10, 2021 and the eight <br />(8) conditions of approval including Attachments A and B. Mr. Bowman seconded the motion. The motion passed <br />unanimously by voice vote. <br />Seventh Item of Business: SPR 20.07: Emergency Vet Clinic at 3352 South US Highway 17/92. A major site plan <br />request to construct an ±8,968 sq. ft. building with associated parking, landscaping, stormwater retention, and site <br />lighting at 3352 South US Highway 17/92. <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in his memorandum dated March 10, 2021 to the <br />City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends the Planning and Zoning <br />Commission approve case number SPR 20-07, based on the staff report and the testimony and evidence presented, that the <br />request meets the applicable provisions of the Unified Land Development Regulations, and is consistent with the <br />Comprehensive Plan as per the written findings in the staff report. He said the waiver and the conditions of approval are as <br />follows: <br />Waivers: <br />1. A waiver request to permit 17 of the 43 parking spaces to be undersized at a size of 9 -feet by 18 -feet. <br />Conditions of Approval: <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to the <br />expiration of this approval. <br />2. The property owner shall proceed with a lot combination of lots 20 and 21 prior to the commencement of <br />construction. <br />3. A tree bank payment of $3,500.00 must be submitted prior to the issuance of a Certificate of Occupancy. <br />4. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />5. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and void. <br />In response to the Commission's question regarding sidewalk connections on this site, Dr. Kelly Brock, Deputy <br />Public Works Director/City Engineer, explained that the sidewalks were discussed during the design of this project. He <br />stated there are no plans in the City's current transportation master plan to construct sidewalks on the south side of Lake <br />Ellen Drive and it did not make sense for the business to extend the sidewalk in that direction. Dr. Brock said they focused <br />on adding improvements to South US Highway 17/92. He said that was a better focus area for this project. <br />
