Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />March 10, 2021 <br />Page 4 <br />Sixth Item of Business: CU 21-05 3352 South US Highway 17192. An extension request to the approval of CU 20.01 <br />to operate an emergency veterinary clinic in the CG zoning district. <br />Mr. Jonathan Tardif, Planner I, reviewed the information provided in his memorandum dated March 10, 2021 to the <br />City of Casselberry Planning and Zoning Commission. Mr. Tardif said staff recommends that the Planning and Zoning <br />Commission approve case number CU 21-05, based on the staff report and the testimony and evidence presented, that the <br />request meets the applicable provisions of the Unified Land Development Regulations, and is consistent with the <br />Comprehensive Plan as per the written findings in the staff report. He said the conditions of approval are as follows: <br />1. The conditional use shall be limited to the location identified within SPR 20-07. <br />2. Additional buffering beyond the minimum code requirements shall be provided to separate the proposed <br />use from the residential uses to the west. <br />3. The business shall remain in complete compliance with all City, County and State requirements. <br />4. There shall be no outside display or storage of goods, materials, services, animals, or vehicles. <br />5. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />6. The conditional use shall commence within one year of approval. <br />7. A new conditional use application shall be required if the use should cease for more than 90 days. <br />8. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question, Mr. Tardif explained that the City Code limits conditional use approval to <br />one (1) year. <br />Mr. Phillips asked the applicant to come forward. Mr. William Hockensmith, 5127 South Orange Avenue, Suite <br />200, Orlando, Florida came forward. There were no questions for the applicant. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. Ms. Brenda Monger, 15 Plumosa Avenue, Casselberry, Florida came to speak in opposition of the request. Ms. <br />Monger said she was concerned with the impact this development would have on the quality of the lake. She said that the <br />Department of Environmental Protection began monitoring Lake Ellen three years ago and the lake is in jeopardy. She was <br />concerned that this proposed development would further impair the lake. <br />Mr. Richard Parnell, 215 Lake Ellen Drive, Casselberry, Florida came to speak in opposition of the request. Mr. <br />Parnell stated he had the same concerns expressed by Ms. Monger regarding the proposed development impacting the <br />quality of the lake. <br />Ms. Mary Parnell, 215 Lake Ellen Drive, Casselberry, Florida came to speak in opposition of the request. Ms. <br />Parnell said she had the same concerns as Ms. Monger and her husband, Mr. Parnell. <br />
