Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 13, 2021 <br />Page 4 <br />A brief discussion ensued regarding what would be required to convert the structure to a habitable structure, <br />enforcement of code violations, and adding an additional condition of approval prohibiting electricity and plumbing to <br />the structure. <br />Mr. Phillips asked for a motion to address CU 21-01. Mr. Bakalla made a motion that the Planning and <br />Zoning Commission approve case number CU 21-01 based upon the five (5) criteria for conditional use approval, the <br />staff report and the testimony and evidence presented, that the request meets the applicable provisions of the Unified <br />Land Development Regulations and is consistent with the Comprehensive Plan as per the written findings contained <br />within the staff report, the ten (10) conditions of approval, adding condition eleven (11) that this accessory structure <br />would not include power, water, or plumbing, and Attachments A — D. The motion failed for lack of a second. <br />Mr. Phillips asked for a motion to address CU 21-01. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve case number CU 21-01 for an accessory structure greater than 500 square feet at 519 Queens <br />Mirror Circle. The recommendation is based on findings of fact and conclusion of the staff report dated January 13, <br />2021, the ten (10) conditions of approval, and Attachments A — D. Ms. Divita seconded the motion. The motion <br />passed with a majority vote with Mr. Bakalla casting the dissenting vote. <br />Sixth Item of Business: ZB 20.04: Rezoning at 198 SR 436. A request to amend the Official Zoning Map from <br />CG (Commercial General) to PMX-HIGH (Planned Mixed -Use: High Rise) for the parcel located at 198 SR 436. <br />Ms. Christina Hyson, Planner II, reviewed the information provided in her memorandum dated January 13, <br />2021 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said staff recommends that the <br />Planning and Zoning Commission recommend approval of case number ZB 20-04 to the City Commission, based on <br />the staff report and the testimony and evidence presented, that the request meets the applicable provisions of the <br />Unified Land Development Regulations and is consistent with the Comprehensive Plan as per the written findings <br />contained in the staff report. <br />In response to the Commission's question, Ms. Hyson explained that PMX-MID and PMX-HIGH are the only <br />two (2) designations that are compatible with the MTMU Future Land Use Designation. Ms. Hyson stated that the <br />applicant selected PMX-HIGH because it allows for a greater impervious surface. She explained that the zoning <br />allows for a greater height, however, the PUD Agreement established the height to a maximum of one story. <br />
