Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 13, 2021 <br />Page 3 <br />Ms. Burke stated that no additional fill is being proposed for the area. She said the Building Department and the <br />Engineer have made a site visit to their property. She said if additional fill is needed, they were informed what steps <br />would be necessary to accomplish that. <br />Ms. Burke stated the plans provided to the Commission are generic plans for the structure. In response to <br />the Commission's question, Mr. Burke said they agree that there will be no water, power, or plumbing. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Ms. Colleen Hufford, 527 Queens Mirror Circle, Casselberry, Florida came forward to speak in <br />opposition to the request. Ms. Hufford questioned the vision for lakefront properties in Casselberry. She stated when <br />she moved into her home 40 years ago there were deed restrictions that restricted accessory structures and she was <br />not sure if the deed restrictions were reviewed for this conditional use request. Ms. Hufford expressed concerns with <br />impervious surface due to the low area on her property and the adjacent property. She was concerned that this <br />could become an industrial use. Ms. Hufford said it is a storage unit within view of her backyard and the neighbor to <br />the left. She suggested using fencing to screen that type of structure. <br />Mr. Bill Hufford, 527 Queens Mirror Circle, Casselberry, Florida came forward to speak in opposition to the <br />request. Mr. Hufford expressed concerns with flooding issues with the additional impervious surface and the inability <br />for Code Compliance to observe violations behind structures. Mr. Hufford suggested the City should send a courtesy <br />notice to surrounding property owners notifying them of conditional use requests. <br />A general discussion ensued regarding that a 500 square foot accessory structure could have electricity and <br />would not require conditional use approval, a structure over 500 square foot requires conditional use approval, and <br />the use of the structure for storage would eliminate the outside storage. <br />Ms. Neysa Borkert explained the conditional use process. Ms. Borkert stated that deed restrictions are <br />private restrictions on the property and the City cannot make decisions based on the deed restrictions or enforce the <br />deed restrictions. Ms. Borkert stated that a violation of the deed restrictions would require in a civil action and some <br />deed restrictions may no longer exist. <br />
