Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 13, 2021 <br />Page 2 <br />Fifth Item of Business: CU 21-01: Accessory Structure at 519 Queens Mirror Circle. A conditional use request <br />to construct an accessory structure greater than 500 square feet at 519 Queens Mirror Circle. <br />Mr. Tatum Jordan -Madden, Planner I, reviewed the information provided in his memorandum dated January <br />13, 2021 to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends <br />that case number CU 21-01 be approved with staffs conditions, based upon the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations <br />and is consistent with the Comprehensive Plan as per the written findings contained within the staff report. He said <br />the conditions of approval are as follows: <br />1. The conditional use shall be limited to the location of 519 Queens Mirror Circle. <br />2. The accessory structure shall not be utilized for any commercial activity or home occupation. <br />3. No more than two accessory structures shall be located on the property. <br />4. The accessory structure shall be utilized solely for storage and shall not be converted to a habitable <br />structure. <br />5. No fill should be brought into the floodplain without compensating storage. If fill is brought to the <br />floodplain, an equal or greater amount of cut needs to be created adjacent to the floodplain area. <br />6. The proposed storage structure will need to be anchored/secured to prevent flotation, collapse, or <br />lateral movement. <br />7. Any additions that increase the height or square footage of the accessory structure will require <br />conditional use approval. <br />8. A building permit must be issued within 180 days of approval. All inspections must be approved by the <br />expiration date of the building permit. <br />9. The use shall remain in complete compliance with all City, County, and State requirements. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A brief discussion ensued regarding the property being located in a 100 -year floodplain, the maximum <br />number of accessory structures allowed on a residential property and the increased size of the concrete pad. In <br />response to the Commission's question regarding the size listed on Attachment A that was included in the agenda <br />packet, Mr. Jordan -Madden explained that the plans provided are generic plans. <br />Mr. Phillips asked the applicant to come forward. Mr. Christopher Burke and Ms. Allison Burke, 519 Queens <br />Mirror Circle, Casselberry, Florida came forward. Mr. Burke explained that the building would be used as a storage <br />facility to store his jet ski, lawnmower, etc. He said it would clean up his yard because he has no place to store these <br />items. <br />Mr. Burke explained that there are three different types of floodplains and the front half of his shed <br />encroaches in the 100 -year floodplain. He said he was not concerned that the floodplain would cause any problems. <br />
