Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />January 13, 2021 <br />Page 5 <br />In response to the Commission's question, Ms. Hyson explained that if the restaurant use was discontinued, <br />the PUD Agreement allows for other permitted uses such as general retail and services. She said in the future if a <br />higher intensity development was proposed, it would require review by the Planning and Zoning Commission to <br />amend the PUD Agreement. <br />Mr. Phillips asked the applicant to come forward. Mr. Erik Madsen, P.E./Landon, Moree & Associates, Inc., <br />31622 US Highway 19 North, Palm Harbor, Florida came forward. There were no questions for the applicant. <br />Mr. Madsen said the development is proposing 10 -foot landscape buffers along State Road 436 and Oxford <br />Road and additional landscaping on the interior of the site. He said there would be approximately 77% impervious <br />surface area. Mr. Madsen said that there would be an underground stormwater management system for water <br />quality treatment which is a requirement of the City. <br />Ms. Hyson stated in the agenda packet there was a draft version of the PUD Agreement. She stated on <br />page 3 of the agreement it states: "Permitted principal uses allowable on the Subject Property: <br />Restaurants, general retail sales and services, business and professional offices, medical services, <br />cinemas and theaters. Multi -family residential, including townhomes, condominiums and <br />apartments, and hotels — interior access only are only permitted after amendment of this <br />Agreement to revise standards as appropriate." <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Phillips asked for a motion to address ZB 20-04. Ms. Divita made a motion that the Planning and <br />Zoning Commission provide a favorable recommendation of approval for case number ZB 20-04 to the City <br />Commission, based on the staff report and the testimony and evidence presented, that the request meets the <br />applicable provisions of the Unified Land Development Regulations and is consistent with the Comprehensive Plan <br />as per the written findings contained in the staff report including Attachments A and B. Ms. Campbell seconded the <br />motion. The motion passed unanimously by voice vote. <br />Seventh Item of Business: Public Comments. <br />There were no public comments. <br />Eighth Item of Business: Other Business. <br />
