The resolution gives the City Manager the authority to review a lien <br />reduction request and make that determination. Ordinance 21-1558 is an effort to adopt the more <br />streamlined process currently being used in real estate matters, giving the City Manager the ability to review <br />and assess requests for lien reductions, while providing potential to go the Special Magistrate for appeal. <br />Discussion: Discussion ensued regarding the proposed ordinance, including streamlining the process; <br />efforts to assist in facilitation of the transfer of non-compliant properties to a compliant property owner; <br />efforts to remedy repeat violations and accumulated fines; granting of authority to the City Manager to <br />assess and determine whether a lien reduction should be granted; potential for alleviating or reducing the <br />burden of a lien on the City's residents; and concerns about future potential for misuse of this authority <br />given to a City Manager or creation of an unfair system. Mr. Bowley explained that there were built-in <br />inherent delays in the process, including due public notice and advertisement and potentially two public <br />hearings that could occur. However, in the case of an applicant that is in a situation where a closing cannot <br />occur due to the realization there is a municipal lien, there would be a real benefit in having the request go <br />to the City Manager to make that decision. Also, this would lead to quicker compliance which is the <br />ultimate goal. The City currently has an attorney sitting as its Special Magistrate and they have a lot of <br />faith in her decision making. Also, there are safeguards built in for those cases where somebody may <br />disagree with what she decides. Ms. Reischmann added that new criteria were added for the City Manager <br />to consider and there is a checklist he can follow when deciding about a potential lien reduction. And, if <br />the applicant is unhappy with the City Manager's decision regarding a reduction, they can appeal to the <br />Special Magistrate and have the public hearing at that time. And, if it is determined the new process is not <br />working to produce good outcomes, then the Code can be amended further. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 21-1558 on first reading. <br />Audience Participation: No one carne forward to address Ordinance 21-1558. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 21-1558 on first <br />reading, as presented. Motion was seconded by Vice Mayor Busch. Motion <br />carried unanimously by voice vote 5-0. <br />11. PUBLIC HEARINGS <br />A.
