CASSELBERRY CITY COMMISSION <br />Minutes of September 13, 2021 — Regular Meeting <br />Page 11 of 19 <br />not being used but couple times a year, that would not trigger any type of code enforcement action; however, <br />if it is in the front yard, not being used, and there's grass growing up over it or it's not operable and there's <br />no evidence of a license, then if a neighbor were to complain, Code Enforcement would go out to take a <br />look because at that point it has become an eyesore and it is creating a public nuisance. <br />Discussion: Discussion ensued regarding potential burden on residents; public safety; whether a license is <br />required for a boat that is not being used or is used infrequently; navigation hazard presented by a boat that <br />is partially submerged in the water; definition of derelict; and screening requirements. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 21-1557 on first reading. <br />Audience Participation: No one came forward to address Ordinance 21-1557. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 21-1557 on first <br />reading, as presented. Motion was seconded by Vice Mayor Busch. Motion <br />carried unanimously by voice vote 5-0. <br />Ms. Reischmann noted for information purposes that any issues relating to motor size and horsepower of <br />vessels would be preempted to the State. <br />B. Ordinance 21-1558 — Amending Chapter 2 Administration Lien Reduction <br />Procedures <br />The City Clerk read Ordinance 21-1558 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING PART II, CODE <br />OF ORDINANCES, CHAPTER 2, ADMINISTRATION, ARTICLE IV, BOARDS, COMMITTEES, <br />AND COMMISSIONS, DIVISION 2, CODE ENFORCEMENT BOARD, SECTION 2-158, <br />APPLICATION FOR SATISFACTION OR RELEASE OF CODE ENFORCEMENT LIENS, TO <br />MODIFY PROCEDURES FOR THE REDUCTION, SATISFACTION, AND RELEASE OF CODE <br />ENFORCEMENT LIENS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, <br />AND AN EFFECTIVE DATE." <br />Staff Presentation: Community Development Director Chris Bowley stated that approval on first reading <br />of Ordinance 21-1558 which amends Chapter 2, Administration, of the Code of Ordinances modifying the <br />procedure for lien reductions is requested. He explained that the City of Casselberry currently has <br />provisions for the reduction, satisfaction or release of recorded code enforcement liens placed on real <br />property in the City as a result of violations of Code compliance measures. The City's goal is to achieve <br />compliance in code enforcement issues, which is preferred over the lien and financial penalty side. The <br />City's Code Enforcement Special Magistrate is the one who determines and sets a fine when appropriate. <br />Currently, the City has both a resolution and an ordinance which address code compliance issues; however, <br />the ordinance is somewhat cumbersome and rarely used, and the resolution is utilized more often as it is <br />
