CASSELBERRY CITY COMMISSION <br />Minutes of August 23, 2021 — Regular Meeting <br />Page 9 of 16 <br />was advertised in the Orlando Sentinel on Thursday, August 12, 2021 <br />Staff Presentation: Planner II Christina Hyson stated that Ordinance 21-1555 approves a new Planned <br />Unit Development (PUD) Agreement and concept plan for two (2) parcels with PMX-HIGH (Planned <br />Mixed -Use: High Rise) zoning that are generally located on the northeast corner of South U.S. Highway <br />17-92 and Grandpine Way and collectively total approximately 1.98 acres in size. The site is currently <br />vacant and both properties are located within the CRD (Community Redevelopment District) and OPOD <br />(Oxford Park Overlay District). Notification was provided to the surrounding property owners within 500 <br />feet on March 25, 2021 and written notices for the proposed zoning amendment were posted on the subject <br />properties on March 24, 2021. The City's Development Review Committee (DRC) approved the concept <br />plan for ZB 2 1 -01 on February 18, 2021. The Planning and Zoning Commission, the City's Local Planning <br />Agency (LPA), voted 6-0 at its meeting on April 14, 2021 to recommend approval of this item to the City <br />Commission. The request for a zoning amendment to adopt a new PUD Agreement and concept plan for <br />the subject properties is: consistent with the City's Comprehensive Plan and the Major Thoroughfare <br />Mixed -Use Future Land Use designation; compatible and consistent with the adjacent land uses and zoning <br />districts; and connections for City water and sanitary sewer services are available to the subject properties. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 21-1555 on second and final reading. <br />Public Bearing: Mayor Henson stated this was a public nearing to hear and consider comments and <br />questions regarding Ordinance 21-1555. Mayor Henson opened the floor for public participation. The <br />following individual came forward: <br />1. Max Sabeti, New Earth Properties, LLLP, 128 East Colonial Drive, Orlando, stated he was <br />the applicant for the Marquis Townhomes Planned Unit Development and was available for <br />questions should the City Cominission have any. <br />No one else came forward to address Ordinance 21-1555. Mayor Henson closed the public hearing relative <br />to Ordinance 21-1555. <br />MOTION: Vice Mayor Busch moved to adopt Ordinance 21-1555 on second and final <br />reading, as presented. Motion was seconded by Commissioner Meadows. <br />Motion carried unanimously by voice vote 4-0. <br />12. OTHER ITEMS <br />A. Review and Discussion of Draft ADA Evaluation and Transition Plan <br />Staff Presentation: Deputy Public Works Director/City Engineer Kelly Brock presented an overview of <br />and solicited feedback on the City's draft ADA Evaluation and Transition Plan.
