OTHER ITEMS <br />A. Contract SOQ-2021-0715 - Construction Manager at Risk Agreement with <br />Wharton -Smith, Inc. for Parks Construction Projects <br />Staff Presentation: Deputy Public Works Director/City Engineer Kelly Brock stated that Contract SOQ- <br />2021-0715 provides for a Construction Manager at Risk Agreement with Wharton -Smith, Inc. for Parks <br />Construction Projects. He explained that in 2020 staff had looked at the potential for this type of contracting <br />to allow the City to construct the park bond projects faster than anticipated under the typical design -to -build <br />process. It was also felt there was an opportunity for value engineering during the design of all the projects <br />and better quality and cost controls in hopes that all the projects could be built rather than one of the lower <br />priority ones being sacrificed. A solicitation was released in December 2020 for Construction Manager at <br />Risk (CMAR) services. Six proposals were received, and Wharton -Smith was ranked the highest during <br />the evaluation process. He further explained that the potential for this contract was over $20 million worth <br />of construction. However, what is being requested for approval tonight is the over -arching agreement that <br />sets the framework for what is to come; it does not actually authorize specific work. He explained that <br />supplemental agreements would be addressed in the following agenda items. Each of the parks will have <br />one supplemental agreement that is intended to cover everything for that park and when each park project <br />is ready to go to construction, staff will bring forward an amendment to the supplemental agreement with <br />a guaranteed maximum price (GMP) to authorize the construction services. <br />Budget Impact: There is no budget impact associated with this item at this time. Work will be assigned <br />through separate Supplemental Agreements as needed, subject to available budget and City Commission <br />approval. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Contract <br />SOQ-2021-0715 Construction Manager at Risk Agreement with Wharton -Smith, Inc. for Parks <br />Construction Projects. <br />Audience Participation: No one carne forward to address the City Commission regarding this item. <br />MOTION: Commissioner Aramendia moved to approve Contract SOQ-2021-0715 — <br />Construction Manager at Risk Agreement with Wharton -Smith, Inc. for <br />Parks Construction Projects, as presented. Motion was seconded by Vice <br />Mayor Busch. Motion carried unanimously by voice vote 5-0. <br />
