H. Exviration of buildinermit. If the work described in any building permit ha 5 not <br />begun within 180 days from the date of issuance thereofsaid permit, hallex ire and it <br />shall be necessary to obtain a new building permit Drior to commencing any caugaction <br />described on the expired The Administrative Official shall provide written notice <br />to theDersons affected. <br />If the work described in anv buildinia oermit has not been substantially completed <br />within two years of the date of issuance thereof. said permit shall expire and shall be <br />canceled by the Administrative Official. The Administrative Official shall provide <br />written notice thereof to the persona affected. together with notice that further work <br />described in the canceled hermit shall not proceed unless and until a new buildingpermit <br />has been obtained. <br />Notwithstanding the above. after receiDt, of a buildingperm,it, if the cause of the <br />developer's failure to Droceed with construction is found bv the Administrative Official <br />to be beyond the developer's control. the Administrative Official may review the <br />conditions and shall be vested with 12ower to waive the expiration and grant a time <br />extension if such action is found by the Administrative Official to be consistent with the <br />regulations contained in the latest edition of the Standard Building Code. <br />1. BuildinQ, permits issued in error. A buildiniz hermit issued in error shall not�confer �m <br />riahts or privileges on the applicant to proceed to construction. The Citv shall -retain the <br />right to revoke the permit and/or require compliance with the building code and <br />approved site plan to the extent lawful.. <br />J. Construction and use to be as provided in applications. permits and certificates o <br />occupancy. Building Dermits or certificates of occupancy issued on the basis of plans and <br />applications approved by the Administrative Official and appropriate City departments <br />shall authorize on1v the usearrangements, and construction set forth in approved plans <br />and armlication. and no other use. arranQement or construction shall be allowed -unless <br />the same comDlv with all wolicable requirements of the land development regulations as <br />well as all adopted buildine and fire codes. includiniz advisory standards of the National <br />Fire Protection Association Code (cross reference Article IV. Section 1-4.1. ULDR). <br />Unauthorized use, arrangement. or construction activity shall be deemed a violation of <br />the land development regulations. <br />K. Violations and penalties Proceeding with any type of construction or use without on <br />approved authorization for a building permit or land use shall be a violation of the land <br />development regulations and punishable as provided in Section 1-2.1 B . <br />Ordinance #97-882, Page 7 of 20 <br />
