Applications for building and/or demolition as well as aoDlications for a change o <br />land use permits are required prior to commencing construction or demolition activitv or <br />change of land use, reSDectively. It shall be unlawful to use or OCCUDV or to permit the <br />use or occupancy of an building or L)remisesor both or -oart thereofhereafter created. <br />erected, chanaed, converted or wholly or partly altered or enlarged in form or use until <br />an aD'Dlication for a building permit or permit for change in land use is approved by the <br />Administrative Official. Similarly. it shall be unlawful to demolish a structure prior to <br />receiving a demolition Dermit. <br />F. Certitzcate Qf occupancy or use required No land or building or part thereof hereafter <br />erected or altered in its use or structure shall be occupied until the Administrative <br />Official and appropriate Citv departments shall have issued a certificate of occuDancv or <br />a certificate of use stating that such land, building. or part thereof and the proposed use <br />thereo. are found to be in conformity with the provisions of the land development <br />regulations. Failure to obtain a certificate of occuDanev before use shall be deemed a <br />violation of the land development regulations. It shall be the dutv of the Administrative <br />Official and appropriate City departments to make a final inspection of the building or <br />premises and to issue a certificate of occupancy if the land, building or part thereof and <br />the proposed use thereof are found to conform with the land development,regulations; or. <br />if such certificate is refused, to state such refusal in writing together with the cause. <br />G. Partial certificate of occupancy. A partial certificate of occupancy is a certificate of <br />occunancv that allows less than full occupancy_of a building which is under construction <br />while minor permitted items are completed. Pursuant to the Administrative Official's <br />determination, the partial certificate of occup_an-cv mav allow occupancy of a completed <br />portion of a buildinQ that is under construction. or it may allow occupancy of entire <br />buildiniz by a limited number of people. The partial certificate of occupancy shall be <br />limited to a specific duration of time as determined by the Administrative Official. but in <br />no case shall the time exceed six months at which time. if the construction is not <br />comnletedthe partial certificate of ocewanev shall exnire, and all occupancy 2f —the <br />buildingmust cease. The Administrative Official may reouire, as a condition of _issuance <br />of the partial certificate of occupancy appropriate conditions and safeguards designed to <br />protect the safety of the occupants of the building and the public, includingblit not <br />limited tothe removal of electric power to the building if the certificate o <br />OCCUDancv is not received within the sr)ecified time <br />indicated on the fot+he partial certificate of occuDancv. Appropriate Citv <br />departments must sign off prior to the partial certificate of occupancy being issued. <br />Following completion of the minor permitted items under the terms of the partial <br />certificate of OCCUDancy, it shall be the duty of the Administrative Official and <br />appropriate City departments to make a final inspection of the building or premises and <br />to issue a certificate of occupancy if the land. building or part thereof and the proposed <br />use thereof are found to conform with the land development regulations: or. if such <br />certificate is refused to state such _Le refusal in writing together with the cause. <br />fL <br />Ordinance #97-882, Page 6 of 20 <br />
