CASSELBERRY CITY COMMISSION <br />Minutes of June 23, 2014 — Regular Meeting <br />Page 10 of 14 <br />Recommendation: The City Manager recommended approval of Resolution 14-2625. <br />MOTION: Commissioner Solomon moved to approve Resolution 14-2625, as presented. <br />Motion was seconded by Vice Mayor Hufford. <br />Discussion: In response to questions from Vice Mayor Hufford, Mr. Newlon clarified that $12,300 was the <br />amount that would be spent to utilize ACi (Associated Consulting International) as a consultant relating to the <br />proposed purchase of this property, and the $12,300 was part of the $25,000 in spending that the Commission <br />had approved in the previous agenda item. He also confirmed that ACi was the City's consultant for other <br />projects in the City, as well. <br />Motion carried unanimously by voice vote 5 — 0. <br />10. FIRST READING OF ORDINANCES <br />A. Ordinance 14-1408— Amending City Code Chapter 58 Offenses Public Nuisances <br />and Miscellaneous Provisions <br />The City Clerk read Ordinance 14-1408 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY CODE OF ORDINANCES BY ADDING CHAPTER 58, ARTICLE VIII, <br />NUISANCES CAUSED BY HUMAN SIGN SPINNERS ON PUBLIC PROPERTY AND PUBLIC <br />RIGHTS OF WAY DIRECTING COMMERCIAL MESSAGES TO PASSING MOTORISTS, <br />PURPOSE, INTENT, AND FINDINGS, DEFINITIONS, APPLICABILITY, PENALTY; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Development Services Manager Chad Lingenfelter gave a brief overview of Ordinance <br />14-1408, explaining that the ordinance was an effort to have signs which are already prohibited in the City's <br />sign code deemed a nuisance which would authorize a code enforcement officer to be able to issue a citation, <br />and start the fines immediately. He added that it would also define the area of a violation so that just by <br />moving 101 feet from the original violation a new violation would be created even if the violation occurred on <br />the same day. He advised that staff had received assistance in preparing the ordinance from both the City <br />Attorney and special counsel. <br />In response to questions from Vice Mayor Hufford, Mr. Lingenfelter confirmed that these regulations would <br />only apply in the City's jurisdiction and if the violation moved into unincorporated Seminole County the City <br />could not enforce it; however, if the violator came back into the City's limits, it would constitute a new <br />violation if it was 101 feet from the original violation. <br />In response to questions from Commissioner Fry, Attorney Babb-Nutcher advised that the special counsel who <br />was brought in was Attorney Bill Brinton from Jacksonville who specializes in sign code issues. She added <br />that he was consulted due to some earlier sign code issues the City of Casselberry had which resulted in <br />litigation. She added that this ordinance was a tool that could be used by the City to enforce its sign <br />
