CASSELBERRY CITY COMMISSION <br />Minutes of March 8, 2021 — Regular Meeting <br />Page 9 of 19 <br />the Official Zoning Map from CG (Commercial General) to PMX-MID (Planned Mixed -Use: Medium <br />Rise) for the subject property is: consistent with the City's Comprehensive Plan and the Major <br />Thoroughfare Mixed -Use Future Land Use designation; compatible and consistent with the adjacent land <br />uses and zoning districts; and connections for City water and sanitary sewer services are available to the <br />subject property. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 21-1552 on first reading. <br />Audience Participation: No one came forward to address Ordinance 21-1552. <br />MOTION: Vice Mayor Busch moved to approve Ordinance 21-1552 on first reading, as <br />presented. Motion was seconded by Commissioner Aramendia. Motion <br />carried unanimously by voice vote 5-0. <br />10. PUBLIC HEARINGS <br />A. Second Reading of Ordinance 21-1548 — Amending Article XIV Tree Protection <br />Sections 3-14.3 and 3-14.8 Regarding_ the Tree Removal Process (LPA 20-11) <br />The City Clerk read Ordinance 21-1548 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />CODE OF ORDINANCES, PART III, UNIFIED LAND DEVELOPMENT REGULATIONS, <br />ARTICLE XIV, TREE PROTECTION, SECTION 3-14.3, PERMIT REQUIRED FOR REMOVAL, <br />TO PROVIDE DOCUMENTATION REQUIREMENTS FOR PERMIT EXEMPT TREE <br />REMOVAL AND SECTION 3-14.8, VIOLATIONS, WAIVERS AND APPEALS, TO PROVIDE <br />PENALTIES FOR NOT SUBMITTING DOCUMENTATION; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 21-1548 <br />was advertised in the Orlando Sentinel on Thursday, February 25, 2021. <br />Staff Presentation: Community Development Director Chris Bowley stated that Ordinance 21-1548 <br />amends the City of Casselberry Unified Land Development Regulations Article XIV, Tree Protection, <br />Sections 3-14.3 and 3-14.8 regarding the tree removal process (LPA 20-11). Mr. Bowley gave an overview <br />of Ordinance 21-1548 which included: the purpose and intent of Article XIV of the City's Code is to <br />establish protective regulation for trees within the City, as the City supports and promotes tree preservation; <br />Section 163.045(1) of the Florida Statutes provides a statewide exemption for specific land uses and <br />primarily defines residential as single-family detached or duplex; under this statute residential property <br />owners are allowed to use this exemption from permitting with specific documentation from an arborist or <br />a Florida licensed landscape architect that the tree presents a danger to persons or property; Ordinance 21- <br />1548 attempts to address some of the differences between the state and local regulations, including: <br />
